Hello there.
Long story short, two weeks ago I bought a used computer component from this seller for a good price, he has 100% positive feedback though less than 30 points. I thought he is only selling one piece and was recently listed for under 10 minutes, so I purchased it immediately before anyone buys it before me. I paid using paypal
It did contain a couple of pictures and description, but I wanted more information so I contacted the seller about basic things such as the typical usage, condition, more pictures, etc. But no replies or contact, item has not been marked as sent yet for two weeks.
Further investigation into his profile shows his previous items and feedbacks. His previous listing are very cheap postcards, for less than 50 cents each, with a generic picture and description, despite this he has many people buying this suspicious postcard and leaving him positive, enthuasistic feedbacks, and his profile is only a few months old.
So I may have fallen into his trap, what can I do? Ebay suggested that after 30 days I should open an Item Not Received case, but I heard as long he has proof that he "sent" the item (e.g. a photograph of the item with the shipping/address sticker), I may lose the case. Is this accurate? It is possible this is their plan after all.

I wish I can show you the link to his profile feedbacks or the listing in question so you can see it for yourself, but it may be against eBay rules.
EDIT: Furthermore, in Paypal transaction page, it states that he is an unverified user too.

No need to wait - go into paypal and open a not received case.
Just to clarify, is this an Australian seller?

You need to open a case in ebay within 30 days and not after 30 days for items not as described.
But you can open an item not received through PP within 180 days which you can do as soon as the estimated date
has come and gone.
Buyers shouldn't panic when they pay with PP as you are protected.

Not in ebay - Paypal is the best for item not received dispute.

Normally I'd advocate to open a PayPal dispute for INR, but sometimes I think eBay is the better option. EBay requires the tracking to show as delivered, whereas PayPal abide by Australian law and only require proof of postage. If the seller does provide a tracking number they could easily win a PayPal dispute.
You can open a dispute any time in PayPal (unless it's changed), whereas eBay you can't open until the last estimate date (allegedly). Either way, if it's coming from an Australian seller, you'd think 2 weeks would see the last estimated date gone, so I'd be trying to open a dispute now.
Just to clarify for the OP, the eBay dispute needs to be opened within 30 days of the last estimate date, not 30 days from sale date.

Hello. Yes the Seller is from Poland. It would not let me open an Ebay INR case since it says I have to wait for atleast one month (30 days) to open a case. Yes I am from Australia. I have to wait until October 3rd for that 30 days minimum to pass.
I am also very confused who do I open a case with since Ebay always tells me to open with them first. And Paypal says to use Ebay Resolution Centre too. But people in the internet and forums sometimes say Paypal should be first.

If you open a dispute in ebay and it fails you can then open a dispute in paypal but if you use paypal first you cannot then go to ebay if it fails.
