Seller refunded a couple of hours prior to us meeting for me to collect item.
I travelled interstate to do this as it was an expensive item.
Can I sue for breach of contract?
Cheers,
Ray

@chezzy wrote:Perhaps we will never know but perhaps the seller got 'cold feet' about the paypal payment, I mean it is a chunk of coin and one does hear about chargebacks and so on *shrugs*
As for postage cost, I would guess there is insurance built into that and I believe Australia Post charges $1.50 per $100 of value so do the sums...
but.... Aust Post do NOT insure jewellery!

Well there you go, guess I will have to go digging for that information. Seeing as I don't wear, buy or sell jewellery. How do you know the seller hasn't quoted a price allowing for insurance regardless - perhaps they werent aware either??

The OP is out of pocket $100?
How much does it cost to sue someone? Under $10 000 for any item, for the small claims tribunal?
If the seller agreed for the buyer to fly and up and collect the watch, poor form to pull out of the deal at short notice.
Did the seller ever relist the same watch? Maybe he got cold feet about what the valuation would be (lower than the purchase price).

One of the Rolex watches was bought for over $6,000. Postage was $100 standard post. You might think it worthwhile picking it up personally????

I travelled interstate to do this as it was an expensive item.
-----------------------------------------------------------------------------------
He was charging $100 postage.
I paid via Paypal that day. Refund a couple of hours later
I flew $49 each way so that we could, together, take item to verify as genuine by the authorised Dealer.
This is called "due diligence".
I also immediately reported him to eBay
Cheers,
Ray

The timeline seems a bit tight to me, unless I have misinterpreted things.
But it sounds as if the buyer paid the same day he flew out to collect and the seller refunded almost immediately.
I am wondering if the buyer had actually okayed the whole process with the seller first.
It isn't something that every seller would agree to, I would not think.
Maybe the seller just didn't want to have to travel to some authorised dealer or thought the buyer might give trouble.
