Seller sent my item to wrong customer, customer won't return said item.

Okay so its a bit of a complicted scenario.

 

I am a bit of a collector so I saw some items that I wanted and I bought them. Note that the items I bought were sealed in original wrapping and have not been open. That is a big deal on the value of a collectors item.

 

Anyway I get a message a couple days later saying that the seller has sent me the wrong item and my items were sent to another person.

So I give him the items back that were wrong and he sends me the items I bought, as he has multiple copys of them.. This was all combined postage.

Only problem is 1 of the items he sent me is not sealed and has been opened and used in the past. I asked him why this was the case and apparantly the item I bought was sent to the wrong person, and this person said he wants to keep the items that were sent to him by mistake and apparantly he is going to pay this seller for them.

I am just wondering what to do. Is there anyway the seller can force this other buyer to return the wrong item sent to him as they were meant for me?

Unfortunately no the seller can not force the other person to return it.

It was an error the seller has to deal with and as your item is not as described then you need to ask for a full refund on return if the item or a partial refund and keep it.

If you open a dispute for item not as described and it is escalated to a claim the seller will have to either send you a label to print off for the return postage at his cost or you return it and the seller repays you the postage cost.

If the seller refuses to refund the postage then contact ebay and they will refund it and then add that to the sellers next invoice.
