How do we stop fraudulent companies selling so called new phones when they are clearly not. this is my 5th experience with 5 different companies. All claiming new phone. This last one, looked good, but finally the battery gave out. Took it to Apple care where they told me, the battery was non genuine, and had leaked. The insides had stuff missing. the case had been glued and had started to break apart and the front screen had been replaced too.
When I asked the seller, yes new.
15 months later, no warranty.
The other one went for a week at battery life went to 94 %. That was easy to work out.
I think they should be fined heavily and forced to refund monies no matter how long it is. Non genuine part in a phone are definitely not new. Also the buyer should keep the phone to smash against a wall. so the seller can't then re sell it after they have clearly violated the new phone category.

Australian law is still applicable to eBay and those that use their platform. 12 months warranties plus there a few others that you won't understand.
And I thought this was a forum for intelligent people, but I was wrong about that too.
With "warranties" Australian law only applies to Australian registered sellers, and any warranty can only be enforced if the seller is an Australian certified seller/ reseller of the item.
Maybe that's a bit hard for you to understand.................

Actually, you don't need a iPhone 13 when you only want to make some calls/text etc. I would buy a iPhone 13 if I want a iPhone 13 specifically, from an authorised seller.
Ebay would have covered you if you reported them as "item not as described" within 30 days of delivery.
Only took you 5 counterfeit phones to realise there is no "warranty" from dodgy sellers so not sure what you're expecting from the forum๐ค

If you only want to make calls and send texts, go buy a smart phone from BigW or the Post Office for $99. Comes with warranty too.
I suppose I can say that you are being scammed by Apple / Microsoft etc, to buy the new phone, computer / program , TV. etc. Wake up to yourselves as well, what you want keep up with the Jones / The Smiths / Vanderbuilt's. I think you mean VANDERBILTโS ๐

Actually, thatโs not correct, so obviously itโs YOU who doesnโt understandโฆ ๐

Yet, youโre the one who has bought 5 phones and then come here complaining about the quality, or lack there of! ๐
