I paid $360 for a Galaxy S4, sent messages to the seller and told me that she has sent it, her excuse is that she lives outbush in QLD and post will be busy this time. I've been waiting for 3weeks now. I have tried to ring her on the mobile ebay sent me, no answer. As this was my first time to buy online I paid it with my credit card.

Springy, it makes no difference whether the OP used a credit card through paypal or direct to the seller's merchant facility....she still has the ultimate protection of her credit card provider.
In fact, now that paypal is refusing buyer protection if the seller can prove that they posted the item, I can forsee a lot of buyers initiating chargebacks if they have not received their items rather than risk paypal not paying a claim.

The op states this is the first time they have bought anything from ebay, well it isn't the first.
They bought the phone on the 7th November and the seller has received good feedback for 2 other sales around that time, the seller has only sold 3 items all up.
An inexperienced seller and an inexperienced buyer can make for a difficult transaction.
The seller's location is Wide Bay, Burnett, Qld.
Is that an out of the way, isolated location? (I don't know where it is.)
Maybe the seller did sell the phone that had the number ebay supplied to the buyer, (thinking/typing out loud can be a good thing LOL)
While everyone is waitng for the OP to come back you can amuse yourselves by reading the feedback she left for the seller the day before starting this thread..

I dont think you've been scammed. Its not worth the risk, ebay have a good name. They wouldnt sell on ebay ifthey were scammers. Far too risky. Good luck anyway. Hope you get your item.

Apart from receiving feedback for a couple of bits of jewellery, the Seller sold 4 brand new phones on the 7th November, all buy it now and all 1 day listings.
It screams Scam to me.
Depending on how you paid, I suggest you either log on to Paypal and file a dispute immediately or contact your bank regarding a chargeback.
