I bought an item as a gift for a friend and it was advertised as Brand New, however when I received it it was actually clearly very used and unsuitable as a gift. I contacted the seller and said I was happy to keep the item for myself but wanted a partial refund. She said "accidents happen" and she must have acidentally listed it as new and to send it back for a refund. What should I do?

Entirely different situation - the item has not even left the store.
I have purchased things in stores and got home to find a piece is missing or the item does not work - so it is not as described. On taking it back whilst I might be offered a full refund, I have yet to get an offers for reimbursement or compensation for my travel costs to return the goods.
yes it is an entirely different situation; if you are buying something from a store you can actually see what you are getting. On line you need to trust the seller to have described the item accurately.
Also postage is bit different to cost of getting to the store; unless the buyer lives very far from the store petrol is not unlikely to be as much as the normal postage is, and in any case, item can be taken for exchange when the person next go to the area for other reason. And going to PO to post the item also uses petrol ๐
By the way, I have NEVER said that this seller deserved NEG, I just said that they did not handle the situation well.
I disagreed with those who said that the seller did absolutely nothing wrong. I would very unlikely have negged this seller myself, but if the OP feels that way about this transaction, it is their right to leave FB they feel the seller deserves.
While those who say we do not know the other side of the story are of-course right, we have to judge on what we are told, not our wishful thinking. Maybe the seller should be invited to put their side of the story? :-x

I do appologise regarding my first comment as I jumped in without conciddering all the facts.
When I read the op, all I saw was the item was not as discribed and the seller wasn't taking responcibility.
I will say this though, there was a lot of very good advice to the buyer regarding the TRUTH about how they should have acted.
Not may people (and rightly so) supported the OP and gave the facts as they stand.
I didn't realise the seller was trying to do everything they could to resolve the issure properly, and my comments were VERY WRONG,
I think however the buyer was going to give bad FB no matter what but just wanted justification for it.

As a seller, I received negative and incorrect feedback regarding postage costs, under the guise of positive feedback. eBay removed the incorrect feedback comment on my request.
