ebay seems to make it almost impossible to open a dispute if people try to be reasonable. I have been awaiting an item from China for months with assurances that the original lost item would be replaced. Now that the 45 days if over ebay seems to make it impossible to open a dispute. Why?

Because it is impossible to open a dispute after 45 days. If you paid with paypal you don't open an ebay dispute anyway....you open a paypal dispute, but the same restrictions apply. You only have 45 days to open a dispute.

Why? Because they tell you very, very clearly that you have to open a dispute within 45 days, It is clearly stated in both the ebay and Paypal terms and conditions when you sign up and tick the box to say you have read them and it is written very clearly on the Paypal page when you go to pay. If you choose to ignore the warnings and allow a seller to talk you out of opening a dispute in time it is hardly ebay or Paypal's fault.
