The Seller should be named and shamed!

This used to happen a lot in the days before Paypal buyer protection. Now with both ebay and Paypal the seller would only get away with it if it was listed in the correct category for photographs and the title said it was a photo, if it was listed under computers there would be no question about them getting their money back.

I would also like to bet that the buyer didn't bother to read the whole of the listing, always a big mistake.

Agreed.....buyers need to check when they are searching and find an item they are wanting to purchase that...

1. The description is detailed and precise and photo's are clearly showing any listed defects

2. The item is listed in the correct category - very important

3. The seller accepts paypal/paymate or merchant CC

3. To ask questions prior to bidding or buying before making the commiment

Then, once purchased pay ONLY via paypal (or other safe method)  and this will not happen to you.

An eBay spokesperson said it was a “very rare” incident, adding they take “the issue of fraud very seriously". BAWAHAHAHAHAHAHAHA, I've got tears streaming down my face after reading that sentence!!!
