my son purchased an electronic item from USA (paid around $300) they sent a different model which they also sell but it is significantly cheaper. He has put in a item not as described and he paid with paypal, but I notice on their ebay site they say returns to be paid by the buyer (if item not as described). How can that be fair when it's their fault?

Yes, there is only 20 days from the moment you opened the dispute. So there is absolutely no way the item will get back and replacement (if sent) would arrive here within the given time.
As was said above; getting partial refund is your best option. The moment the seller started contacting you outside the dispute process, I would stop trusting him; next he will say he cannot do anything unless you close the dispute, or he will just wait for the 20 days to expire.

so the seller is now contacting me via the paypal dispute process they have agreed on their to refund my return shipping which was $99 aud. I have until the 3rd October to escalate the claim however when I went to escalate it, I only have the options for request refund or partial refund, I really prefer to get the item I ordered which the seller has promised to do, but obviously this will not happen before oct 3rd im assuming? I sent back yesterday. Not sure what I should do from here

I open this discussion in openly confessing I sent an incorrect order to someone, which should have been sent to another buyer. Even after profusely apologising to this person, offering a refund on postage and Express Posting the correct item to them, the person was incredibly difficult in communicating with in order to get the incorrect item back, and when I asked them to send back the item COD all communication stopped.
My fault, I get it, but...
This person still hasn't posted back the incorrect item, has received the correct item, and now says I haven't a leg to stand on in regards to getting the item back (was incredibly rude in their final communication when I stated I would put the matter to the Resolution Centre). Why am I not protected against people like this, who expect to keep the incorrect item along with their purchased item. It goes against the fundamental principle of a contract/transaction! The person that I have sold the item to now doesn't get the item and I have to provide a full refund. And on top of it I get my first negative feedback and have to wear it for attemping to get the item back.
Any comments? I understand I basically have to wear it this time and learn from the mistake.

This is a 9 months old topic, not really relevant to you srcur2308 as this topic is about getting wrong item. You should start your own topic, so people will answer to you, not commenting on the long resolved case.

Firstly, it is considered good Board practice to start a new thread rather than tag onto an old thread if you are wanting advice on a specific problem/situation, especially when it is not similar to the one in the opening post from over 6 months ago.
Secondly, you can't blame eBay for your predicament as eBay would never advise sellers to send the correct item if they hadn't received the other on back. They can't put policy in place that protects sellers from doing stupid wrong things like you did.
Thirdly, . . . . nah . . . . I'm done . . . . . I am fed up with all of these Zombie Threads that seem to be appearing. I count at least 8 in this last week alone. If I didn't know better, I would think that some posters are posting with multiple IDs just to wind up those of us that genuinely try to help people on these boards. I think I will have a break from the boards for a while . . . . . after all, I won't miss anything . . . . . . because any new threads while I am on my break will re-appear in 6 to 12 months time and I can read them then!

another reason for taking a break will be to work on my typing speed. Once again these slow old fingers were beaten to the post by another.
Good advice super, I would have beaten you to the bit about starting their own thread had I not gone on a rant. I started typing my reply at 3.50pm but kept changing it (and toning it down A LOT).

It doesn't only apply to overseas sellers Digital.
I had an Aussie Ebay seller do exactly the same thing to me a few months back who also stuck to the Paypal concept that I had pay the return shipping costs even though it was the seller's at fault, and they wondered why I gave then curry over it X-(
Had they contacted me and told me they were out of stock of the model of item I had purchased before deciding to ship any alternative to me, no matter if of better or lesser quality/ability/cost I would have been happy to sort it out with them, but they didn't make any attempt to do so, just made their own arbitary decision. One in their favour I would add.
They did end up getting it back, and It did pay the return costs, but in the process I went for a full refund rather than wait a few weeks for them to get new stock of the model I wanted, so in the end they lost a sale valued at $440 and a very negative feedback into the bargain.
That certainly didn't please them at all because up until that moment they had enjoyed a 100% pos rating record.
Then began the saga of me receiving emails from them begging for a feedback review and my refusals.
I'm sure they attempted to have that feedback removed but it still stands today.
No doubt I'm on their BBL, but do I care? Not in the slightest 😄

Hi i bought a new battery just before going overseas late last year. I was upset that after i gave all the correct details for. The new battery for Samsung
Galaxy note 3. I received a battery maybe 2 cm too small but same width as the original.
I went overseas for an extended time. As such when i returned the same battery was misplaced.i have now found that wrong battery.
So for me to be an ongoing customer of ebay im expecting someone to get back to me to rectify this issue!?

This thread is EIGHT years old.
The rules have changed many times since then.
eBay won't do anything - you have 30 days from receipt to claim not as described.
Paypal won't do anything - you have 180 days with them.
It is up to you to ensure goods are as described in a timely manner. Which 9 months isn't.
It against board policy to name and shame, or to publish personal details. This information will be removed by a moderator shortly.
eBay do not read or respond to board posts, so any email you get purporting to be from eBay will be from a scammer.
