The seller also has to provide proof that the buyer received the goods by signing for them because anything can still get lost in the mail.

I won a Paypal dispute for the same reason when the item was lost somewhere with the seller putting up a valid tracking number.

No they don't they only have to provide proof of postage on the .au site. You may have won your dispute, but the seller shouldn't have had to fund it, as they had proof of postage and thus, seller protection.

That's how it works with Paypal protection, which is what you get here. eBay protection requires proof of delivery, but that doesn't apply if you buy through the Australian site.

I certainly wouldn't rely on your thinking Davewill because the Fair Trading Act of Australia says something entirely different, and they're the body that Paypal is governed by in Australia. Paypal is not a law unto itself as many people tend to think, including Paypal very often lol.

Well I most certainly will get involved because this is within my specific area of expertise.

So which part of the Fair Trading Act do you say overcomes, or is in conflict with, the deemed delivery provisions as contained in the Sales of Goods Act.

Dave is 100% correct. PayPal Australia only require proof of shipping, not proof of delivery, and it doesn't matter if the buyer actually received the item or not.

I suggest you read the (Australian) PayPal Buyer & Seller Protection policies, so you don't have to rely on anyone's 'thinking'. 😉
