would you expect to receive a new or worn item?

What is the point of tags if the item has been worn?  The whole point of "new with tags" is that it means it has never been worn, or washed; it looks the way you expect new item purchased from a B&M store to look like. 

So to say "as new with tags" is the same as being "born again virgin"  :_|

I would decipher that as a new item thats been around for a while but cant be called new.

with tags doesnt mean they are in the pocket, it means they are still attacked and the item hasn't been washed.

your post #7 describes a huge deception and I would not be happy, it deserves a neg and 1star for item description

make it clear to them that lies like that are not acceptable
