received damaged item seller offered refund

item arrived damagedon the 7/1/14 contacted seller straight away, she offered a refund I accepted, Paypal acc shows on the  24/1/14 refund status removed,(does that mean she stopped payment) then the two days later received from Paypal refund pending 29/1/14, today 30/1/14 received notification from Paypal refund failed

lodge a not as described claim and the seller responsed with sorry hope you get your refund now.....still nothing showing up... how long should I give her to pay before escualting to a claim

You only get 45 days to put in a dispute so if you're prepared to wait then make sure you claim before the 45 days is up
