a seller  claims I have to cancel the dispute before he can refund after sending  defective item. Is this true?

And if you close the case, you will not be able to re-open it again when the seller does not refund you at all

And he/she has no intention of refunding you if he/she told you that you had to cancel the dispute

Just remember you need to follow through with the dispute as soon as it allows, and before it times out

Exactly right. The seller is hoping to sucker the buyer and is hoping he'll get away with not refunding at all.
