ripped off by seller

My daughter bought Radiohead tix some time ago (I've only just found this out) for Sydney - paid $798. She didn't check the tix straight away and just before the concert realised that they were actually not tickets for the Sydney concert. She contacted the ticket seller and he promised to reimburse her - many times. The last contact he had with her he told her he was having financial difficulties. She has since found out he is actually on holidays right now! 



Anyway - I think there is no solution because of the time delay, but does she have any recall at all with Ebay over the tickets? I'm guessing she has left it too late for both Ebay or Paypal. I'm not real sure of how it all works, have been a buyer for some time but never had any problems. Thanks...

No you aren't allowed to name the seller, you can give the full title of the listing though.



Your only recourse may be if the Paypal payment was funded with a credit or Visa debit card, if it was then your daughter may be able to do a chargeback through her card provider, don't leave it any longer though as some banks have time limits.



She can also report the seller to the police using this link:

It is run by QLD police but contains all the information you need to report for any state.



She should send the seller one last email informing them that unless she receives a full refund within 48 hours she will be reporting them to the police.

I believe that PP does not cover tickets.  I cannot believe that the seller would not say where the concert was; surely you cannot sell something like tickets unless people know where the concert is.  For $800 tickets it may be worthwhile to catch a plane to whatever city the concert is.

Thanks everyone for your help. I will let my daughter know about the Paypal option. I only found out last night she still didn't get the money back. She was specific about the tickets for Radiohead being in Sydney. Her fault was not checking the ticket I guess when she got the email. However, she did email him as soon as she realised and he promised on a number of occasions to reimburse her - "I'll put it in your account on Monday..." etc. She has called the number for this person and has discovered that he is on holidays now for 3 weeks (there goes the financial distress argument from him...) However, he is still selling a multitude of tickets for a lot of different things so he will be still checking his Ebay account. I have emailed him and asked him when he is going to sort it out. I think my daughter's fault is that she believed him each time he said he would repay her. He acknowledged she got the wrong tickets. My daughter has said something about Paypal not covering the tickets. The Radiohead concert is now finished. She ended up going to the venue in Sydney and buying some there - so she spent a lot of money on them! I will take on board the suggestion from phorum_junkie (thanks!) to report the fraud, but I think it is more that the seller just doesn't want to reimburse her so far down the track. I've checked the seller and there are a couple of negative feedbacks but he is quite a bit ticket seller and would appear to be an honest person. Even though she's an adult, I'm just being a protective Mum and I'm dirty that he gets away with $800 and I want to try and solve it. I've emailed him in no uncertain terms about what I think of him and I'm quite sure he won't respond. He has stopped answering her emails as well. Will just keep ringing the number we have I guess and try that way. Thanks again everyone for being so helpful!

OK - got a bit more information that I probably should have clarified first...! My daughter bought the tickets for the concert specifically name and dated. The seller sent her the tickets for the wrong day! I'm a bit special at negotiating Ebay and the listing number. Her ID is dirty_vegas023 - but I can't seem to get in to see her history... I thinks he will email him through the seller shop and let him know she will be contacting the Police. If it was only $50-$100 I would say cut your losses, but clearly he is enjoying his holiday partly with her hard earned money! If I can get a link I'll put it here. Thanks again.

I am afraid if they were just tickets for the wrong day she may have a job getting anything back if the tickets are now invalid.



Why didn't she just re sell them herself as soon as she realised they were not the ones she wanted?

I cannot see anything in your daughter's history, but that is only for 30 days, or if the tickets were sold with private listing they would not show.  What your daughter has to do now is to give him NEG, so future buyers are careful.



While you cannot name the seller, you can post (copy&paste) the title of one of his existing listings.  Or the title of those tickets your daughter bought.

Hi. She didn't resell them because she was always told that she would be reimbursed - she wanted to just get her money back but the seller was just a joke and lied every time. She could have done that - but was a little naive and believed the rubbish he told her.



I don't know if she can give a neg now because it is so much later. I thought she had missed the feedback time. 



I emailed him myself today and threatened him with reporting fraud to the Police and also taking legal action. He emailed back and said it would go in tonight. I truly don't believe him but have given him a timeline to deposit the money and then I go straight to the Police. He knows I'm not happy with them in no uncertain terms.
