seller : sold me a fake iphone and i cannot communicate..
ebay wont refund me the $189 for the counterfeit purchase...
accumilates at least10 negative feedbacks a month and ebay deletes the negatives over a period of time...
watch and take note of member how the negatives disappear over a few weeks... alot of disappointed buyers...
if ebay didnt delete the negatives all the time i would never of bought anything from this seller.. so who is to blame???

I was overseas for a period and seller promised to resolve the issue, but seller was slow to respond so dispute time had expired.. Mind you it took a few weeks to deliver from Melbourne as stated on listing to NSW..Scammed with false advertisement.
The phone was for a 4 year old child to play with and google which is what i wanted so there is no itunes to play with..,
i was sold a phone with apple logo and it didn't work.
The contract was for a working goophone..I received a counterfeit apple logo phone that did not work.
I am a consumer to a registered Australian business, therefore i am entitled to a refund. ebay deletes the sellers negatives once a dispute has be complete.. so on average this seller has over 10 negatives in the last few weeks , currently 3 negatives last week 6, seller has beat the system.. do you think i would buy a electrical product if seller had over 100 negatives a year.. Well if ebay disclosed all the negatives about the seller i would not buy so i believe ebay is liable to some degree..

I still struggle to believe that people don't know the User Agreement they signed when they joined.
If ebay DID NOT remove the negative feedbacks buyers don't buy from a bad seller equals less sales less fees less money ebay receives!

So you believe a comsumer of a online company is not intitled to receive a refund because comsumer selected a different payment option?
It doesn't matter what I believe, not only is this the law, but there is plenty of information around explaining how to keep yourself safe when trading on line.
Additionally, because I know the site user Agreement, I also know that you are not entitled to a refund from eBay in this instance. Yes, you should get a refund, but not from eBay. and the way to get that refund was through ione of the safe payment methods.
May I ask if you have done anything to provide proof that the item you purchased is counterfeit/fake?
It don't matter what payment option i selected! Item was received over 20 days(listing stated shipped from Melbourne, fast dispatch) i complained to seller. Seller responding slowing then promising to take care of transaction. All the seller did was delay with unsatified customer and promised to offer refund and days go by dispute cannot be filed..Seller succeeded in what he set out to achive in the whole dealing..
The time frame is irrelevant when you pay for bank deposit - there is no buyer protection! The time frame is only relevant when you choose to pay through a safe p[ayment method and then utilize the protection.
The seller suceeded because you didn't know the rules.
It's that simple.
so, before you buy again, from anywhere, know the rules, laws and policies that govern the site that you are using.

You paid by bank deposit, there was no "dispute timeZ"

I bought my kids a $30 phone from a B&M - does all that and they're not 4

So, purue the relevant authorities for the sale of counterfeit goodas and online fraud,

I agree and i am aware of the user agreement and that ebay doesn't except responsibility if buyer buys a counterfeit product.
That is part of a clause that ebay has ammended.
Ebay do not allow replicas, counterfeit items, or unauthorized copies to be listed on eBay.
The seller has sold me a counterfeit with a trademark apple logo and i am no the only one that seller has sold too.
Ebay ignores buyers negatives that state fake product received and lets the seller continue to do business.
Fact: Ebay deletes the sellers negatives after a dispute has been finalised!
Therefore ebay has to take some responsibility for this particular transaction.
Everything about the sellers store and listings are misleading.

If no deletion of negatives are conducted by ebay : A. I the buyer would stay away from the seller in question. B. the seller would not increase revenue for ebay. ( ebay receives all final value fees after a dispute has been finalised)
Lets say this item i purchased was $10,000 and i payed bank deposit don't you think i would win in court over ebay?
Of course i would win hands down , but this is only small change and not worth a day in court!!!!!!!!!!!!

Why would they need to accept responsibility for such a transaction? They are not a party to the contract and they make it very clear that a seller is responsible for the c9ontent of their listing,

True, but as they are not authorized to establish the authenticity of products, they are not legalally able to make such accusations without proof.

Could it be because none of those people making those statements have taken the steps to verify that the items are counterfeit? Without verification from an authorized person, those claims are simply defamation and unsupported accusation. eBay is NOT in the business of identifying counterfeit items.

No. No they don't. Not without proof. None of which seems to have been supplied. For all eBay knows, you're a competitor running around trying to trash his business by making false statements.
