So I bought some weights off this guy and now he wont respond and his phone is always busy. Its been 3 weeks and because he has until Nov 30 ebay wont do anything. He's registered as living in the same state as me and it's clearly a scam. What can I do? Feeling pretty dumb for not checking out the buyers details first.

go into you purchase history and from the drop down menu click on I didn't receive this item. This will then lodge a item not received dispute. if you don't hear anything after the date specified by ebay make sure you RING ebay and tell them.
What was the reason they won't do anything.
If ebay don't do anything then you can always open a paypal claim if you paid that way (i hope you did)

The goods are coming from overseas and have an estimated delivery time of 23 business days. You cannot open a dispute until the 23 business days are up. That is nearly 5 weeks and as you said, it is only 3 weeks since you bought the item.
There is still time for them to turn up.

You should give it the 5 weeks then I would open a Paypal dispute rather than an ebay one as that is better for items not received, ebay is better for not as described. I presume you paid with Paypal.
As it is a new, no feedback seller and something of that weight coming from China I suspect even if you receive something it will be far from what you are expecting.
It says in this book I am reading that by 2065 80% of women will be overweight.
