I wondered if anyone could tell me about their experience with starting a case with ebay over an item they didn't receive. If it was a long process and if they got their money back?
I'm lucky enough to never having to start a case with anyone or leave negative feedback. I've had a few sellers been really slow to post or item not as described, but it's been resolved between us, or I just haven't left any feedback.
Anyway - my phone is on its last legs and a few friends have had no trouble buying a second hand phone on ebay - so I had a look round. I bid on a phone that was second hand from an Australian seller, which was listed as being in good condition and they were only selling due to upgrade. The seller had 10 positive feedback. It was marked as sent a few days after payment, this was 3 weeks ago. As It was coming from within Australia and hadn't arrived after a week, so I messaged the seller to ask which state it was coming from and tracking details as I was getting a bit worried. I got a very short message back to tell me WA. As im in NSW, I thought fair enough - ill give it more time. Then a week later - still no parcel and checked at the post office. So I sent a very polite message to ask for exactly where and when it was posted, tracking details ect,, so I could try and trace it with the post office, but no response. I messaged again with no response.
So yesterday I see three people have left negative feedback, saying no item and no response and asking for refunds. The phone I bought (idetnical listing) had been listed 6 days later and was bought by someone else, who didn't receive it. So i started a case with ebay. It says they have 8 days to respond then I can go ahead and with a claim.
Does anyone know how long it all takes. I'm pretty frustrated as 1) they have my money and 2) in the meantime my phone is still on its last legs and I could have bought one from somewhere else.
Its also quite strange that someone would have glowing feedback and then suddenly disappear. The annoying thing is, I can see she left feedback for a seller for something she bought just two days ago - so shes on ebay, but just ignoring messages. It seems weird.
Sorry to ramble on. If anyone has any thoughts - it would be much appreciated. x

Do you mean you have opened a dispute through ebay? That would only happen if you had not used Paypal. I hope you mean you paid using Paypal and opened a Paypal dispute because that is the only way you will get your money back.
If you paid by bank deposit then you have no chance of a refund, you could report the seller to the on line auction fraud report site but chances are they are not in Australia but have used false details to open the account or have hi-jacked an account and are probably in Nigeria or Eastern Europe.

Thanks so much for your response Phorum_junkie. Yes I definately paid using paypal. But it looks like I may have done the wrong thing. I went to customer support on ebay and followed the links and opened the case in the ebay resolution centre. As i thought that was the right thing to do.
I just tried open a dispute on paypal - but it gave me the message that I had already opened the dispute with ebay and wouldn't let me proceed. I'll ring paypal and ask what to do next.
Im wishing I had asked you before I started the dispute.

That should only happen if you purchased through the UK or US site, if your seller is in Aus and you purchased through the Australian site then you would normally be sent to the Paypal site to open the dispute.
Did you pay through ebay checkout?

Yes, I just paid through ebay checkout as usual, a few days after won it. The day I won I messaged them that I would pay through paypal in the next few days. And a few days later I Just clicked on pay now and went through the usual paypal checkout. It all looked straight forward, Ive used paypal hundreds of times.
I only look at Ebay Australia, I have that as a tab, so that is what automatically opens. The listing was near the top - not under international sellers or anything, so I took it as they are here.In the description It lists the item location as Australia and only posts to Australia. I also checked her member ID once I stared to have problems and it says the location is Aus too.

When you started the case, didn't you have to answer how you paid?

Yes, thanks for you advice. I rang paypal and you were right - it was listed on ebay.com the us site. So i wait for 7 days to see if the seller responds then hopefully ebay make a decision in my favour and it takes up to 5 days to be refunded in to paypal.
Thanks so much for that. I guess I was just scolling down looking at different phones and didnt notice I had gone on to the US site. And as it was listed as in Australia and was in Aus dollars I didnt notice.
So hopefully I will get a refund as other people have obviously had a problem with this seller. Their feedback has gone down from 11 to 7 as they have got negative feedback now....
In the meantime, I guess ill get a cheapy phone for now and save up my pennies for a new one - ha.
