what happens when you pay for an item (by bank to bank transfer in australia) and you don't receive the item?
I opened a case, seller didn't respond, case was closed... what about my refund? ebay should refund what I paid for the item + shipping, how do i get this back ??

because you didn't use a safe payment method, if your seller doesn't voluntarily refund you, there is pretty much diddlysquat that you can do.
Why should eBay refund your money? They don't have it

request the sellers phone number and try ringing them - apart from that - consider it a donation, cos that's what you did.

why pay with bank to bank transfer?
use PayPal and your money is safe, bank to bank offers absolutely NO protection and you have lost your money.

My problem is I purchased an item from a Hong Kong Merchant, paid by PayPal and waited the 21 business days for Delivery. This was back in September. The trader asked me to wait a few more days and contact him if it still hadn't arrived. This I did. I contacted him end of September and he promised to send a replacement item but due to Public Holidays in Hong Kong October 1 - 6 he wouldn't be able to post it until 07 Oct. With the 21 business days delivery, when it hadn't shown up by 30 Oct I sent another email and received an automated email back saying that they would be closed until March next year. This means it has gone over 45 days for Paypal Resolution and I am unable to leave negative feedback. From reading this site it seems there is no way I have any recourse for refund or feedback. Main problem is, I think, me being a sucker and believing everyone in this world should have my ethics and honesty.

Paypal clearly tell you when you read the terms and conditions on joining and then again every time you make a payment that you have to open a claim within 45 days and I cannot understand why anyone would allow a seller who has failed to deliver the goods within that period to talk them into leaving it too late. Even if you want to give them more time you can open the dispute on day 44 and then wait nearly 3 weeks before escalating to a claim.
As for the OP I have to agree that such an experienced member should know very well the implications of not using a safe payment method and as ebay warn at every stage that there is no buyer protection if you don't I can't see how they can in any way be held responsible.

Thanks for the info phorum_junkie* I'll do that in future. With the seller closing up shop until March I don't think there's much chance of a resolution on this one though.

It's a pity you have lost your money.
As far as I am concerned, if a seller hasn't resolved an issue and then goes on holiday for 4 months, that isn't good enough and you probably should have opened a case straight away against them. If they are away, they would not have disputed it and you would have had your money back from paypal.
The only thing you can do is save those messages and when the trader comes back in March, copy and paste the whole lot abd message him to let him know you don't have the item. See what happens. If he is ethical, he may try to do the right thing by you. You can only hope! Good luck. I know what a disappointing feeling it is when you pay in good faith and are let down.
