Anyone advice about rental contract pls?.......

Can son get out of his rental contract as of tomorrow? Appreciate any eggspert advice on here pls.Rental Contract has been in place all this yr up to sometime in Dec. He is a 3rd yr uni student just about to start exams.He rents from a reputable R/E company up in Perth. Same property and adjoining for last 2 years-upmarket 'respectable area' etc, no probs.Has own room, lockable and share rest of house amenities-e.g bathrooms, kitchen, 2 fridges, laundry, living with other students and....recently non-students. My son rang a couple of days ago, bit 'upset' obvious damage from someone's unsuccessful attempt to 'jimmy' open his bedroom door. Lock undamaged and room not entered, nothing missing. R/E agent told etc.

My son is a sports science student. Clean living, no smoking, no alcohol, active in sport and training etc

Earlier today son rang more 'upset' ....and asked    "Mum can I come home please?....I don't feel safe here..." Police were called as one of his housemate/fellow students had bricks thrown through their bedroom window while his housemate was out, two fridges ransacked (which contains all housemates foodstuffs) then on return to house son's housemate was attacked by the perpertrator who threw a chair at him and caused physical injury. My son only one home while all this was going on, poor kid.Turns out high quality drugs are involved and large sums of money owed. Police have placed a neighbour-about 30-40 yrs of age on a 'warning'!!?......housemate has 'disappeared'. Son wants out of there.He has texted R/E agent what is going on, that he is leaving 2moro as he does not feel safe. He has exams starting in 10 days. Plan to pick him and his belongings up first thing tomorrow and bring him back to Bunbury. 'Grandad' based in Perth (long way from son's uni, but trains and buses are good) has offered son a room for the 8 day block exam period in 10 days time.

 

What do I ask/say at Real Estate office when we hand keys in tomorrow pls?.....don't want to have to keep paying rent after tomorrow, as original contract was up until early/mid December, can't remember exact date in Dec.

sorry paints, I hit the wrong button.

Get Son out immediately. Is there someone that he can stay with tonight. Do not leave him there under any circs, even if you need to pay for a motel room tonight.

Tomorrow contact your local Fair Trading Dept or who in your State administers and regulates Real Estate Agents and/or rentals.

Also speak with the Agent, but not the Property Manager ask for the Licensee in Charge.

I was an Agent in NSW for 30 odd years and came across this situation before.

I am not trying to frighten you but the next 12 hours are critical. Get him out.

Will be up to the RE though, whether they let him out of  paying rent until the contract ends.

Thanks Jean. Exactly how I am feeling. But was thinking I was being too protective a mum or whatever. Am fuelled up ready to take other son to an appt in Perth 2 moro but.....I am outta here and gone in 10 mins. Thankx

We did speak to the agent-she is very nice But she is in hospital, really sick with suspected TB of all things.

Says an agreement cannot negate tenant rights

 

 

The lessor cannot make a residential tenancy agreement containing terms or conditions which contract out of the Residential Tenancies Act 1987 (the Act). A tenant and lessor can agree to have clauses added as long as these don’t change the rights and obligations under the Act.

 

So look up the Act, and there are more links on that one.

Sounds like a dreadful place to be 😞 I'm quite sure that if you / son explained all the details to the R / Agent, they may be able to work something out.  Hope all works out for the best. 🙂
