Many Australians were wondering why Carlton the rabid racist, was allowed to continue his rants against the Jewish population for so long.
Section 18C of the act makes it unlawful anything that is reasonably likely to offend, insult, humiliate or intimated groups of people on the grounds of race, ethnicity or national origin.
The Herald’s editorial position supported the retention of 18C, and many columnists were also sympathetic to its cause.
So the Herald Sun backed the retention of 18c, a direct assault on free speech but it has now come home to roost for them. Poetic justice perhaps.

Section 18C of the Racial Discrimination Act makes it unlawful for someone to do an act that is reasonably likely to “offend, insult, humiliate or intimidate” someone because of their race or ethnicity.
Section 18D of the Racial Discrimination Act contains exemptions which protect freedom of speech. These ensure that artistic works, scientific debate and fair comment on matters of public interest are exempt from section 18C, providing they are said or done reasonably and in good faith.
I do not think anybody has a leg to stand on in this case. Why should members of the Australian Jewish community feel humiliated by journalists writing factually about something that Israel is doing?

The law of the land as it stands today is he violated section 18c and he is being sued for it.
In what way did he violate it?
His articles was about Israel, not Australia.
The original complaint was about the cartoon which was not his work and which was based on fact.

Maybe Wayne Karlen should be sued for wasting the time of the Australia Human Rights Commission. He is not personally offended because he is not even a Jew. He just didn't like what was said on the ABC's Media Watch, (according to blot).
He even says that Jewish organisations have stated they will not be taking similar action in light of the Herald’s apology.
There. I never thought I'd agree with anything bolt said.

The Australian understands at least one member of the Jewish comminuty has also lodged a complaint.
Jewish organisations have stated they will not be taking similar action in light of the Herald's apology.
I agree with supernova re not a leg to stand on.

maybe the op could ask the mods to change the thread heading, lodging a complaint is not the same as "Sued".
