Clive Palmer calls for clerk of Senate Rosemary Laing to resign

Billionaire politician Clive Palmer has called for the clerk of the Senate to resign unless she is able to maintain impartiality, following a staff email she wrote implying Mr Palmer was a bully.

A leaked internal email sent to Senate staff on Thursday, and obtained by Fairfax Media, reveals clerk of the Senate Rosemary Laing warned staff not to tolerate ''unacceptable behaviour'' and made reference to the ''conduct of a member of the House of Representatives''.

While the email does not directly name the MP, it was widely reported two weeks ago that there was an altercation between Dr Laing and Mr Palmer, the member for Fairfax, over amendments to the carbon tax repeal bill.

Mr Palmer, leader of the Palmer United Party, was annoyed that the clerk would not distribute amendments put up by one of his senators, Glenn Lazarus.

The clerk argued that the amendments were effectively a monetary bill and constitutionally could not originate in the Senate.

In her staff bulletin issued on Thursday, Dr Laing warned against what she described as workplace bullying.

''You all have the right to a safe workplace and that includes the right to step away from - and report - bullies, whatever their status,'' she wrote. ''None of you need have any contact with the member in question if you feel at all threatened or intimidated by him.''

Mr Palmer told Fairfax Media he did not raise his voice during the exchange and said he told the clerk: ''If you do not circulate this amendment by Senator Lazarus I will challenge [your] position in the High Court.''

But on Thursday Mr Palmer took that position further. ''Australian democracy is far more important than this issue. The clerk is supposed to be impartial; if she is not up to the job, resign,'' he said.

Fairfax Media approached Dr Laing's office for comment, but was told she is on leave. The deputy clerk of the Senate refused to comment on the matter.

In the email, Dr Laing also took a swipe at the behaviour of the press gallery over the past two weeks of Parliament, describing reports of the carbon tax repeal negotiations as ''unethical''.

''In all of my years here, I do not believe I have seen anything so unethical from the press as this … [including a] disgraceful episode of press gallery members eavesdropping on private negotiations in the corridors over the carbon tax repeal legislation and writing stories on that basis,'' she wrote.

Last week all the major parties and the crossbench in the Senate - except for the PUP and Motoring Enthusiast senator Ricky Muir - spoke in praise of the clerk.

President of the Senate Stephen Parry said: ''I have full confidence in the clerk of the Senate and her officers. All Senate staff serve the Senate in an entirely professional and impartial way and I reject any claims to the contrary.''

No-one can read Palmers' mind.....and for some to presume or outrightly declare and label his opinions on Q&A as an 'outburst'-when he was simply giving his strong opinion then secondly describe his opinion as 'angry' - this in itself is okay with me even if he were! then thirdly presume that the only reason he spoke was because really he was very very angry about his business venture with 'XXX Company'......???

.....no credence IMO

I'm sorry, Paints, but the "enemy of my enemy" is not necessarily my friend, and quite frankly I don't believe Clive Palmer is anyone's friend

Palmer suffers new defeat in brawl with Chinese giant Citic Pacific

http://www.theaustralian.com.au/national-affairs/palmer-suffers-new-defeat-in-brawl-with-chinese-gia...

Looks like Clives house of cards is starting to tumble

CLIVE Palmer has suffered a defeat in his brawl with Chinese giant Citic Pacific after his efforts to take control of a key iron ore port in Western Australia’s Pilbara region were knocked back by the Federal Court today.

In Perth, the Federal Court threw out his application to become the security operator at Cape Preston, while in a separate case in Sydney, Federal Court of Australia Justice Robert Buchanan overturned an earlier judgement giving Mr Palmer’s flagship resources company Mineralogy control of the port.

The rulings are a blow to Mr Palmer’s long-running efforts to wrest control of the port from Citic.

The federal MP’s private company, Mineralogy, argued in court earlier this month that the federal Infrastructure Department erred last year when it removed Mineralogy from its role in charge of security at Cape Preston and appointed Citic instead.

The department’s decision to approve Citic’s maritime security plan — a key measure in combating terrorism — paved the way for the Chinese state-owned company to begin exports from its $10 billion-plus Sino Iron project last December.

Sino Iron and Mr Palmer’s Mineralogy are joint venture partners in the Cape Preston Port which has been used to export iron ore since late last year.

However the two companies have been locked in fierce dispute over control of the port, which was built and funded by Citic Pacific.

Mr Palmer claimed the federal decision to accept the maritime security plan had allowed Citic to lock out Mineralogy’s employees at Cape Preston.

But in Perth, Justice Neil McKerracher ruled against Mineralogy and ordered it to pay Citic’s legal costs.

“Mineralogy’s complaints cannot be sustained,” he said in a judgement. “I have rejected Mineralogy’s arguments on each point.”

Citic said it was “pleased” that the Federal Court had upheld the department’s decision.

In a separate legal action over control of the port, lawyers for Sino Iron and Citic Pacific had argued Mineralogy should not have been granted federal government approval to control the port as it failed to meet a string of key requirements.

Among other things, Mineralogy had failed to demonstrate how it would enforce security at the international port, Sino Iron barrister Alan Archibald had previously told the court.

Mineralogy lawyer James Peters SC rejected claims the company had been improperly appointed to run the port and that Mineralogy had the “blessing of the state” to do so.

In January last year the federal Department of Infrastructure announced Mineralogy would be the port operator ‘for the security regulated port of Cape Preston’, but later reversed that decision, alleging it found “fundamental factual inaccuracies and omissions” in Mineralogy’s plans for the port that would have compromised security at the facility.

It concluded that the allegedly false claims in Mineralogy’s maritime security plan meant it was “not likely to properly … contribute towards reducing the vulnerability to terrorist attack of the port or to reducing the risk that the facilities at the port are used to facilitate terrorist or other unlawful activities”.

Sino Iron sued to gain control of the port but in February The Federal Court ruled in favour of Mineralogy.

Sino Iron appealed and the court this afternoon ordered the orders of “February 5 be set aside” and that Mineralogy pay Sino Iron’s legal costs.

Mineralogy directed The Australian to a third party media consultant, however the consultant could not be immediately reached.

The government might not like what palmer and lambie said (although it sounds very much like andrew or alan or the Tele ) but what of ''freedom of speech'' ? I'm surprised the usual suspects in the comics haven't defended his right to say something so stupid , after all the right defend andrews right to pick on people he doesn't like, even if he gets the facts wrong and attacks fair-skinned indigenous people who aren't foreign governments or companies but descendants of the original Australians for absolutely no reason . Palmer is a drongo but he has some great role models in government and the rubbish media..

Frankly I dont trust any member of the current government, at least Clive gives me a laugh a times. And YES it's all about Clive BUT as long as he stays on the path he is on, then Abbott's "lets get rid of the poor" budget is dead in the water and that suits me just fine 🙂
