The cheque was from Telstra for an overpayment of my deceased brothers phone account, the cheque appears to have been stolen from his mailbox, Telstra tell me the cheque has been presented, so I assume it's been banked/cashed.

i'd go to the police, they would be able to follow it up.

Inform telstra that the check has been stolen, ask them for the cheque number and to follow it up. They should look into matter for you. If you have the check number and bank you'll be able to find out.

Telstra actually gave me the cheque number when I called them today asking where the refund cheque was, when I asked for more details about the cashing/banking of the cheque he claimed not to know any further, he did tell me the date it was either cashed or banked. I phoned the Bank my Brother banked with and they told me it hadn't been banked into his account.

Ooops I gave you a kudo instead of replying lol
I will call Telstra again tomorrow and quiz them further, but he did offer to begin with to put a stop payment on it, it wasn't until he looked further into it when he found it had been presented.

wouldn't you think a telstra cheque would be marked non-negotiable. That should mean only the person named on the cheque can bank/cash it.
When we were going through a divorce settlement years ago the other side said they hadn't received a cheque from us. Our bank did a trace for us, and got the bank and account that the cheque was presented to. It cost us 10 bucks for the search. And yes, the other side had received and banked the cheque. Lying trollop she was.
oops, but I digress. perhaps your solicitor could get telstra to follow up on where the cheque was presented
