this raises many questions and points of discussion.

 

very sad case indeed, but did anyone set out to kill this boy? no of course not.

 

why is it we are now in a time where every one needs someone to blame and then sue when something like this happens.

 

will getting a big payout bring the boy back? no it wont.

 

what it most likely will do is remove excursions of any kind from all schools.

 

why is it we cant get our heads around the fact life is fickle, sometimes bad things just happen.

 

as a new member of the aussie population this mother certainly knows how to find a lawyer.

 

suing the school ect prolly wouldnt have even occured to me unless a lawyer called me and even then i would hope i'd tell them to go jump, not making money from my grief.

For goodness sakes. We live in a country full of nasty critters that bite. What was the school supposed to do? Run around the morning of and tell all the bitey things to go out for the day? The world has gone mad. The really sad thing is, the school will pay up to keep their reputation. Make them look good, even though there was nothing they could do to prevent it. I'm guessing now that there will be a cull of snakes, just like when someone gets bitten by a shark.

Suing everybody and everything is the American way. It has slowly crept into Australia and is getting worse by the day.

 

I am having tests done and treatment for health problems. Every time a Doctor sees me I have to sign some permission papers and get a list of risks involved at the procedure.

 

Life is a risk and unless someone hurts another on purpose, I can not see the reason for suing. It looks as if money is more important than the accidental loss of a life.

I went to the emergency section of my local hospital recently for a red belly black snake bite ( yes true story ) and had to wait in the waiting area for awhile before being seen by a doctor. ( I wasnt actually dying )

 

While I was waiting I chatted to another bloke around 40 yo who was also waiting to see a doctor. I asked him what he did for a crust. He said he was retired. I was pretty suprised as he was a fit, strong young buck. I asked him what his secret was....... Answer..... He sued some-one, sent them broke and got all thier assets.   Nice one mate   !!!

 

I know of another similar fit young fella that is also retired after doing a similar thing. He got a huge payout from Workcover. He told Workcover he was too badly injured to ever work again. He can still climb ladders to paint the house, mow the lawns, kick the footy etc. and looks a lot fitter and more agile than me. The only problem he has now is that he sits around the house getting bored and cant take on a job as it will mess up his payout. He asked me to teach him how to run an ebay business so he could earn some sly cash and have something to do. I just dodged that rerquest. LOL

 

He might not have to work again, but 40 or 50 years of sitting around the house doing nothing when other guys his age are building businesses and careers might be some justice......... Maybe there is a god    Smiley Very Happy

I used to teach & I can tell you now that every school I know of has quietly settled out of court several times for what I believe are minor things.

The dept does not often contest cases, they tend more to just go into damage control.

For example, someone was walking past our school and walked into a tree branch that was overhanging the path.

 

That was good for several thousand dollars.

 

A child tripped over his own foot in the playground (it can happen). Got a fracture in the wrist or elbow (I forget exactly where)... ditto.

 

So this snake case is the tip of the iceberg.

 

Where there is negligence, fair enough.

But where damages are minor and all due care was being taken, I am not sure courts should award payments. It is out of control.

 

I will tell you a true story. I won't mention the school.

Teacher spoke to a child who was walking out of the room during a lesson. A child who is often in strife.

Teacher demanded he return and sit down.

Child yelled at her, told her to F* off F'ing fat b**ch.

 

later when questioned, he said he was traumatised by teacher rasing voice.

teacher was ordered to apologise as part of damage control.

They would have had to sack me, I would not have.

I know this will seem like I am making light of a very serious issue, however.......

 

Many moons ago I worked in an office with a young guy who was running late for work and, in the rain, slipped on the wet concrete path from his front door. He knew his leg was broken and yelled for help from the guys he shared the house with.

 

They came outside, assessed the situation, moved him as gently as they could out onto the footpath and then went back inside an called for an ambulance.

 

You see, in those far off days, the old Workers' Comp only covered you after you had left your property......

Report him to Workcover as anyone found to be cheating the system has to pay back what they have

 

received in compensation,(they have special investigators that will film him).

This is the real problem. We now have ambulance chaser law firms advertising " no win no fee" , " Its your rights"  carp on TV  and targeting the adds to the bogan morons who think its all OK.

 

The judiciary seem to play along with the little game, awarding huge payouts for things that " just happen " in life. If the judiciary where more responsible only awarding payments in clear cases of negligence, the ambulance chaser lawyers would soon pull their heads in and the system would return to some resemblance of balance.

 

Maybe the snouts in the trough mentality of the political and legal system has reached such endemic proportions that this is all just seen as normal now.

its no wonder pauline has her supporters, 2 months, dead child, hand out for a payout.

 

it does nothing for the imigration of people from poor countries.

 

next thing mum will be driving around in a mercedes and living in a new house, all on the death of her child.
