My Mums update thread

This thread is dedicated to my Mother and her recovery.

On Monday the 4th June 2007, while holidaying in the UK with my Father, my Mother was struck by a van while crossing the road.

Mum spent 88 days in various UK hospitals before finally being brought home back to Australia on the 30th August 2007.

She is currently in The John Whittle Nursing Facility with brain damage

I have set up this thread to keep you all updated on her condition and her improvements and hopefully one day, Mum will be able to read it.

Oz laws a generally based on English law and if it operates the same way there as here the TPI covers people not at fault, the passenger would under normal situation make a claim from the driver/owner TPI


 


If the driver was determined to be at fault then every thing comes back onto his insurance.


 


If your mum has been determined at fault the passenger would still go the drivers insurance and then they would then seek to recover from the at fault party.

Would travel insurance cover that , as Az suggested ?


Though I should imagine that Amy's Father's solicitor would consider all of these things ? 


Perhaps they have though not explained that to their client ?

it is hard to get all the details from dad.


 


The driver was not at fault. It was just a terrible accident.


You could look at it as Mum being at fault as she stepped off the kerb.


But, its hard to explain the way Blackpool promenade was set up and how it was confusing to pedestrians.


Mums accident was not the first accident and Blackpool council had been told by city engineers that it needed to be changed as it was a safety hazard.


 


Neither the driver or passenger were injured at all.


 


 


I dont know how it involves insurance companies, the drivers or the travel insurance. All i can get from dad is that the passenger says they are suffering from stress and the case is for compensation.


All i could get from dad is that he is worried he will have to pay the compensation and also his legal fees.

Im sure they have, but my dad's state of mind is not the same as it was before the accident.

Injuries are not only just physical ones and I suppose everyone is different with the amount of stress they can handle. The insurer may try to recoup legal fees but I believe the travel insurance will be responsible for them. My child was injured OS on an equestrian exchange, she was covered by the travel insurance, as was the horse, even though the horse was not hers but made available to her while competing. Not the same but  travel insurance covers most things inc liability.

That's as I would have thought it to be Az .It may be a bit more involved this long after the accident ? 


 


 


Im sure they have, but my dad's state of mind is not the same as it was before the accident.


 


 


I hope that things aren't as bad as your Dad fears Amy .

tried to talk to dad again about the court case.


Tried to ask some of the questions that you guys had addressed.


He started having a panic attack.


Said he couldnt talk about it. It was keeping him awake at night

Amy - have you asked your dad if you can get into contact with his lawyer?  If he gives permission the lawyer should be able to share with you and answer your questions.

my sister and i discussed that.


She is going to try and speak to dad about that. It might be easier for her as she is with him, not on the phone like i am
