THE jury in the manslaughter trial of former Bundaberg surgeon Jayant Patel has retired to consider its verdict.
Earlier, a judge has told the jury in the trial that they are duty-bound to pay attention to the evidence when deciding whether he is guilty or not guilty.
In the Supreme Court in Brisbane, Justice George Fryberg began his closing address just before midday on Monday, using a PowerPoint slide presentation to help the jury of five men and eight women to consider their verdict.
"It is your duty to pay attention to the evidence and to say whether he is guilty or not guilty," Justice Fryberg said.
"You must determine the facts and that includes determining what evidence to accept and what evidence you do not accept."
He stressed the burden of proof lay with the Crown and asked the jury to "ignore" anything heard outside the case and to put aside "any feelings of sympathy or dislike".
"The accused is presumed to be innocent and you can convict him only if the prosecution established he is guilty," Justice Fryberg said.
"The prosecution must prove guilty beyond reasonable doubt."

Well, I know people that were treated by that dirty a man... one that stands out is a bloke that Patel did a hernia op on.... it got a bit infected after so he went back for a check up... Patel put him on the examination table and proceeded to clean him and and re-suture him without any form of anesthetic or gloves...
oh.. and the young boy that had an emergency circumcision. He too got infected and had to go to his own doctor to get fixed up...
Bundaberg is healing well after this mans behaviour... the many families that lost loved ones after Patel treated them will never be fully ok but life has moved on and the town has worked darn hard to get back to a positive feeling for our local hospital...
If he is found not guilty it will be hard but we are on the path of healing already... there is no one holding their breath waiting for a guilty verdict.

You are right, Az. They often bury their mistakes, and families are none the wiser.

Look at that doctor that infected at least 50 women with Hep C in Victoria. He'd been abusing drugs for years, and was allowed to practice while a drug addict.
It went on for years before he was caught.

Yes..... many cases of inappropriate treatment, wrong meds, overdose of meds.... often go unreported.
