The High Court has issued an interim injunction preventing the transfer to Sri Lanka of 153 asylum seekers who are missing on a boat bound for Australia.
The injunction, granted late on Monday in Sydney, applies at least until a hearing resumes on Tuesday afternoon at 2.15pm.
The asylum seekers are represented by Ron Merkel, QC, who argued to Justice Susan Crennan that the transfer was illegal because the asylum seekers had been deprived the ability to have their claims properly assessed.
But it is not clear whether the transfer has already taken place because Immigration Minister Scott Morrison has refused to comment and his lawyers told the court they had not received instructions.
Sources said lawyers were representing the asylum seekers through their families and they have not been in touch with them since contact was lost more than a week ago.
All you have to do to stop this kind of thing is to communicate. It can't be that hard surely?

why use quotes from nov. 2012, unlike some, most know and have been vocal about not supporting the ALP position on asylum seekers - yet the current govts actions are todays news - keep up.

Having trouble with history today it would appear:
"Since 2012, more than 1,000 Sri Lankan asylum seekers have been returned by the Australian government. A Guardian and Human Rights Law Centre investigation revealed that Australian authorities in Colombo ignored claims that a returned asylum seeker had been tortured in Sri Lankan prison, sparking criticism that Australia employs a strategy of โwilful blindnessโ on the plight of those returned."
Lets see 2012, wasn't that the two ring Circus in town time, with ring masters Poor Me and Rudd ? Now why would they have been returning Sri Lankan refugees, or were they suffering from "wilful blindness" , do they also lack appreciation of the date?

The federal government is committing "piracy" on the high seas by capturing asylum seekers in international waters, Malcolm Fraser says.
The former Liberal prime minister said on Wednesday he would have handled the present asylum seeker problem similar to the way his government approached the exodus of Indochinese refugees in the 1970s and early '80s.
Mr Fraser said he would also want a different immigration minister.
"There would be some dramatic changes in policy. We wouldn't practise piracy on the high seas and capture a boat in international waters and take everyone off it," he said.
"To be apprehended by an Australian customs vessel ... what do you call it? Kidnapping? Piracy? It certainly is in breach of international law."

what you somehow fail to understand monman12 is that I and many other posters do not/did not and never will support the ALP's current policy/position on asylum seekers - I think that is the difference between some progressives and some conservatives - we can openly admit when we don't support something - unlike some conservatives who seem unable or unwilling to ever ever admit that not everything the LNP does is wonderful and right. Yet we are called myopic - it would be funny if it wasn't so repetitively boring.

Please, the favoured citizen journalist rags here are actually self styled "Independent", and always seem to be of a pink hue, as are some of the other journals that Kampmark writes to: CounterPunch, Dissident Voice, and Eureka Street, and I have never been a fan of Julian Assange either. I judge, based upon what was written, not written, and the above:
The writer has written:
A brutal civil war, brought to a particularly brutal conclusion in 2009 by the Singhalese dominated forces, has done nothing to reassure advocates about the fate of returned Tamils โ who, by the admission of Sri Lankan authorities, will face
โ... rigorous imprisonment."
The facts so far are that of the 41 passengers on the boat that left Sri Lanka, 36 were Sinhalese and 5 Tamil. So far all have been dealt with by Galle Magistrates Court and other than facilitators/crew have been released on the equivalent of $10.00 bail . The other 153 "missing" boat passengers (economic and ?) will never be allowed to enter Sri Lanka, whilst India, the original place of departure, will not accept them either.
Of the first boat an official has said:
"They will be charged under the Immigrants and Emigrants Act. The sentence for those proved to have left illegally is two years of rigorous imprisonment and a fine."But if there are any facilitators, then they will be tried even if they have left via an authorised port legally."
Sri Lanka law is not our purvue.
The "fate of the returned Tamils" is mentioned but not the returned Sinhalese, or that they are obviously economic migrants is overlooked to make a 'partial' point.

well, well, well...three holes in the ground. The ADF hot issue briefs have been updated. You may remember way back in early
September 2013 (about the 6th) it appears a "glitch" stopped the site being updated
...It must have been a corker because when I checked in Oct, Nov,and dec 2013
Jan, Feb, March April, May... and June of 2014 and the site had not been updated but now it has been.
