The New York City Police Department said a man driving a Range Rover with his wife and 2-year-old daughter inside Sunday struck a motorcyclist on Manhattan's West Side Highway, breaking his leg.
The SUV driver pulled over, and the bikers surrounded his vehicle, hitting it and spiking the tires, police said. The driver pulled away, hitting three more bikers in the process, police said.
Should the driver in the SUV be charged?
What do you think of bikers?
What would you have done if you were the driver in the SUV?

"Police said Lien is not expected to be charged"

The case of Scott vs Shepherd provides the precedent for how situations like this are handled by law.
I'm not sure tht its helpful to cite a precedent set in an English court when discusing an inceident that happened in USA.

It was on youtube, I can't find it
2 guys try to rob a convienience store in US. THe store owner acted in self defence and ended killing one of the robbers.
The law works that the other robber was charged with murder instead of the store owner.
So applying the same rule. THen the bikers who instigated the whole thing and provoked should also be charge for the injuries caused to the coma guy and the broken leg guy.
felony murder rule ???

Joe you need to do a little reasearch on the difference between AWD and 4WD systems, I always thought you knew a lot about cars
do i? hahahahaha
you said....
yes a SUV is very similar in size and style to a 4 wheel drive just not made to go bush bashing
you made it sound like suvs have no off road capabilties at all
if i were the driver, seeings that it was an suv, i wouldve taken it cross country if the opportunity arose and bashed the bush with it too

This is what I see...from the video.
1. The bikers are clearly chasing the Suv for some time.
2. One biker, pulls directly in front of the Suv and slows down and stops. (goes under vehicle).
3. At least 20-30 other bikers stop, some lay their bikes down around the Suv.
4. A white van is allowed through and continues down the road.
5. Surrounded by at least 20-30 people and bikes, the driver goes forward to escape the situation.
6. The bikers give chase and ultimately bashed the Driver.
From what I have read -
.."Police say Mieses — a father of two from Lawrence, Mass. -- was struck by Alexian Lien’s SUV when he sped away from a pack of bikers who were attacking his vehicle after a fender-bender..."
.."
.."Meanwhile, the biker who is accused of causing the fender-bender that set off the chase appeared in a Manhattan courtroom to face charges of reckless driving and unlawful imprisonment..."
A biker was at fault for the "fender-bender" that caused the other bikers to take chase, not the SUV driver.
Mob mentality from the bikers caused this situation.
The SUV driver is the victim multiple times in this story.

from what i have read despite the high profile attorney miese's father has approached he is not going to get anything out of suing as he was partaking in illegal activity at the time of his injury - he was riding unlicensed.

Asked whether Lien was within his legal rights to race away from the scene of his accident with Cruz, Police Commissioner Raymond Kelly said he might have been.
"It depends on whether or not your vehicle is being attacked, whether or not you think you’re being attacked, whether or not your wife and child are in the car. You have to look at the totality of the circumstances and that’s what we’re doing,” he said Tuesday.
"Obviously, if you can get out of there without hurting someone, that’s what we advise you to do," he added. "There’s no one-size-fits-all to a situation like this."

Was he?.... It is also clear from the video that his own deliberate actions caused him to be run over. I have no sympathy for him.
If the suv could have slowed down faster and stopped, no doubt Miess would have been the first to pull him from the vehicle.

mieses was hit when lien fled from the pack after they were slashing at his tyres and trying to get into the vehicle.
he is in hospital in a coma.
his lawyer insists he was trying to help his buddy cruz who is the one who stopped in front of the suv, claims he was just trying to help his fallen buddy with a broken leg.
He was being a good samaritan and is a victim. *cough*
the lawyer watched a different video to the one i saw as clearly cruz did not have a broken leg....

Edwin “Jay” Mieses, 33, is in critical condition with a crushed spine, two broken legs and other injuries from Sunday’s confrontation,
captured on a viral video that has drawn more than 4 million hits on YouTube.
"There's no hope for his back," his wife, Dayana Meises, told reporters on Tuesday. "They broke it in two different places, so he will
be forever, forever paralyzed."
I was under the impression Mieses was the rider who slowed the suv down.
So that was Cruz....
Their own deliberate actions caused their injuries.
The suv driver was acting in self defence.
