The New York City Police Department said a man driving a Range Rover with his wife and 2-year-old daughter inside Sunday struck a motorcyclist on Manhattan's West Side Highway, breaking his leg.
The SUV driver pulled over, and the bikers surrounded his vehicle, hitting it and spiking the tires, police said. The driver pulled away, hitting three more bikers in the process, police said.
Should the driver in the SUV be charged?

yes, i saw that.
In the one I watched that was almost 7 minutes it showed them coming up on the black SUV and the blue jeans man stop/slow in front the block him. It didn't appear as though he did anything wrong. Just got in the way of the wrong people at the wrong time.

Bob, it is not the duty of lawyers to decide whether or not their clients are telling the truth - they are there as a mouthpiece, to take instructions from their client ant present their case in the best possible light.. Unless a client admits to his lawyer that he is guilty, the lawyer is bound to presume innocence.

to clarify my above point. If the lawyer did not know exactly what happened. I guess they can justify their defense. But if they have seen the footage and know what happened. They cannot knowingly lie.
That's like if their client robbed a bank and there's footage of the client robbing a bank. The lawyer cannot knowingly say, their client didn't do it.

911 Calls Portray Frantic Situation
On Thursday night CBS 2 learned more about a series of frantic 911 calls made from inside of the SUV.
The first came from driver Alexian Lien as the vehicle was surrounded by motorcyclists on the Henry Hudson Parkway.
The next three calls were from his wife who was in the car along with the couple’s 2-year-old daughter.
She can be heard describing a desperate situation as the incident played out.
We are “being surrounded”, “being followed,” she told the operator.
During a final call from 178th Street, she told the dispatcher that the bikers were “attacking the car.”
It took emergency officials seven minutes to respond, their sirens can be heard in the background during the final 911 call.
In addition to 911 calls made by the family on Sunday, there were 200 calls made regarding bikers involved in reckless driving and making noise, CBS 2 reported.
The calls were placed between 11 a.m. and 3:30 p.m. Some callers reported that bikers were even riding on the sidewalk.
The NYPD told CBS 2 that aviation helicopters were deployed to identify groups of bikes to police being dispatched on the ground. Officers inspected 300 bikes and made 15 arrests as a result of complaints.
I think that's self defence there.

I wonder how this would affect the case legally.
The biker that got ran over is attempt to sue. Here is his record:
Edwin E. Mieses, 26, of 17 Bernard Ave., Nov. 28, charged
with
operating a motor vehicle after license was revoked,
illegal
possession of a Class D narcotic, operating a motor vehicle
with
defective equipment and on five outstanding warrants;
Arrested Again
in May, Since 1999, he has been ticketed by police 16
times, in Lawrence,
Methuen, Roxbury, Andover, and New Hampshire,
according to registry
records.
In June, the Registry notified the National Driver Register
that
Mieses was a habitual traffic offender whose right to drive
in
Massachusetts was revoked until 2017, records show."
Doesn't strike me as model citizen just minding his business and if he didn't go on the rode since he has been banned than this wouldn't have happened to him.
