They're given the right by virtue of them being humans and responsibiility will be enforce on them once they're able to comprehend their actions.

I guess I am saying since humans have the intellect to make decisions and it is not instinctually in humans to be unkind to any species, with this intellect comes responsibility.
Something that goes back a long way amongst tribal elders.
To intentionally hurt or kill flies, one could say they have the right to live.
To instinctively shoo or swat a fly because it has impeded the human, is the tribulations/accidents of life.
If I have a fly in the house, I will chase it into the back of the house and open the door.
