Ì bought an item from eBay Seller in Germany its been nearly 17 days?

That's not an abnormal amount of time, but I hope you paid with Paypal as it's not a requirement on the ebay.de site, which tends to attract more scammers than other eBay sites around the world. If it still hasn't arrived after 28 days, I'd lodge an MBG claim with Paypal or an INR claim with Paypal. Of course, before doing so, I suggest you contact your seller first.

I'm in constant emails between me and my German Seller.  But nothing is clear where my item is?

I contacted Aust Post and they did an investigation and came up with my item has been sent by sea

and it will take 12 weeks to arrive?  Absolutely defies logic?!

I will NEVER deal with this seller and German DHL again

After 30 days from the date of payment, lodge an eBay MBG claim and you should receive a refund. Then if and when the item ultimately arrives, refuse delivery and it will be returned to the sender (hopefully via the same mode of transport).

I have had a good look through the MBG T&Cs and can find nothing which would prevent you from lodging a claim, and once you have been refunded you can buy the same item locally instead.
