You are right to ???? this. NO, it is NOT LEGAL for them to do this. Whilst the Mobile Item is on a Legal Binding Agreement with the said Telco, e.g. Telstra, Vodafone,Optus, etc, etc, they hold the ownership of said item, till the contract is finished, or paid out.
Selling the phone to you, does not release them of their original contract obligation, and gives you no cover/protection if the said Telco "Blocks" Telecommunication access to this phone. Hope this helps you.

It is quite legal to sell an unlocked phone with a contract it all depends on the agreement.
There is nothing in law to prevent this.
