i opened a dispute with paypal

my item hadnt been posted the seller responded and said it would take a further 3 weeks. the problem being is that is longer than the time given to escalate the dispute further and my case closes. should i ask for a refund now or am i still going to be able to take action to get my money back if they dont post it.

Ask them to refund now and if they have not done so in 24 hrs then open a dispute for item not received and escalate to a claim as soon as the system allows it.

DO NOT let them string you along till it is too late to take action no matter how nice they may sound.
