Please help. Ordered a collectors item in July 2022, constant excuses

Please help. Ordered a collectors item in July 2022, constant excuses as to why it hasn't been sent. It appeared to be a kickstarter type of small business deal but it is still not ready. I opened a claim in October and was told it would be there next month, come January same thing except now Ebay has closed the "did not recieve item" case as the time elapsed has been so long. 

I have records of all of the excuses, agreeing to refund me and failing to do so.

I cannot move forward with Ebay procedures as they consider the matter "dealt with" and the 30 days to appeal has passed (as the seller continuously promised delivery within one month and never did this)

How can I force the seller to refund my money please?

They have agreed to, but have not done so, and I have no buttons to press to ask Ebay for help as the seller has cleverly tip toed around the guidelines for refund, placating me before allowing the appeal time to expire and still I have no item and am unsure how to proceed.

It is well over $100 and I would like it returned as promised. The item no longer appears in search under the same identification number, ebay won't accept my invoice numbers and they are too "old" and the cost of the product has been slashed and relisted. How can I request Ebay assist if they feel they already did and I did not appeal as I was told "just one more month" repeatedly.

You are out of options after all this time.  The seller has played you promising "just one more month".  It appears you fell for it and they know that it unlikely a buyer with so little buying experience will know the drill.  You really needed to contact Ebay about it when the item had not arrived within the ETA. 

If you paid by C.Card you could try your bank for a charge back but that probably is too old as well.

Ebay is 30 days and Paypal is 180 days.

I suggest before you buy any more go and familiarise yourself with the "Buying on Ebay"   Never let things go this far.  Sorry this has happened but you have to know how to protect yourself.  The tools are there for buyers protection but you have to use them.

I am 31 this year and my mother taught me to win auctions at the age of 6, "but when I was younger" eBay actually helped people who paid money and weren't sent product. I haven't just left them alone for almost a year, I've bothered them repeatedly and they are a literal store in Japan. I was told it was a pre-order item, not yet made, Hideo Kojima little doll for my partner, almost $200- still selling them but hasn't posted mine from last july, opened a case about it, just told again it was a preorder, okay cool, so far not too tricky, they agreed to refund me but they haven't done it yet (doesn't that mean anything? they agreed on ebay's platform to refund me and haven't?) I would have chased it harder if I wasn't told it was a pre-order. I do have a lot of reciepts here, has ebay truly become so bad I've been scammed by a Japanese figurine store and I can't do anything about it? I'm also chasing up a dress that was never posted, back in December, that one I can do something about but ebay aren't doing anything yet, just saying she should respond soon. This is ridiculous. Sad it's ended up like this, this place used to be cool.

Did you chase it up at all with Ebay or just the seller. They unfortunately can say anything and never do what they say. If you spoke with Ebay, how long ago was that and what did they say about it?

Preorder had delivery expected within two months, due to be made a month before shipping but just given constant delays and now an agreed upon refund that isn't happening. This is from Oct last year ""Dear co, we are sorry for the inconvenience, the maker postponed the release day to next month. would you like to keep the order? please close the case if you do, item will be shipped as soon as its released. or we are happy to cancel the order and issue full refund back to you if you decided not to wait anymore. please advise, thanks regards LUNA PARK" I repeatedly requested a refund and was told they would do it or cancel the order and the money would return, neither have happened and ebay have it so difficult to report - being a preorder is different, should have made that more important when explaining original post

They are a business seller, they havent received any feedback on any sales of these Hideo Kojima figures - I don't think they even exist. They are a mid sized store with thousands of sales and none for my item - does it even exist?

You can't

What you need to do is read the buying basics

You are given all the tools you could need to cover yourself

BUT you need to actually use them

AND you needed to use them within the time limits rather than spend close to a year letting the seller play games with you and still expect for eBay to help you

eBay are not going to do anything, and even, as said too late for PayPal

I thought because they were a Japanese fan store and it was a preorder that it was a reasonable answer. So scummy. I lodged everything and they just dodged it all.

Your mother should have taught you how to use ebay properly, actually she should not have let you use it at all before you were 18. Now instead of blaming ebay for your ignorance of procedures, take it up with your mother.

The problem is that ebay would have handled this, in any time we are living in, other than now. They always have. How on earth is a PreOrder that keeps being delayed, allowed to fly under the radar? They've never successfully sold a single one of these things. But taken people's money. That's a crime.

You opened a claim and FAILED to complete the process. Take responsibility instead of blaming the world. But I suppose we are in a time where people think they are not responsible for their own actions.
