Hi,
I made a purchase of a citizen watch on eBay and paid for the purchase using Paypal. When the watch arrived the watch box was damaged and the build quality of the box was very bad compared to a similar citizen watch with the same mechanism I had purchased from a different (trusted) seller a month ago. Also, the seller failed to stamp the warranty card with his details.
I did some research and found the seller's company listed on the productreview.com website:

There are numerous reviews claiming the seller is an eBay scammer who sells refurbed products as brand new and falsely claims that the products are under warranty even though later on when customers try to make a warranty claim they told the product is not covered by any warranty.
After reading all these reviews I decided to request the seller for a refund and told him that I would be returning the product. I posted the product back to the seller and sent it with registered tracking. The tracking indicates that the product was delivered and left in a safe place but the seller is claiming he did not receive the returned product. Based on the reviews of the seller on productreview.com I feel like this seller actually received the product but is claiming not to have as this seems like the sort of scamming behavior this seller engages in based on other customers' reviews.
Can eBay please help me get my refund for the product I returned?
Open INAD in Paypal, you will be advised to send the item back and when they make this request upload the tracking details you have in to the dispute.
The dispute should close in your favour as Paypal only require proof of sending - you should then receive your refund.
If the seller tells you they can not refund until the case is closed DO NOT believe them, just let the case come to it's end, have no further contact with seller and leave the negative feedback even if they ask for a revision.
Hi, you shouldn't put your personal details on a public board. At any rate this is just a board for discussions and people can only give you advice. If you need help from eBay, you will have to contact them via live chat. Was there something wrong with your purchase? Why do you want a refund? If you just changed your mind, does the seller accept returns?
Contacted Paypal and they requested I wait for eBay to conclude their investigations before submitting a claim with PayPal. This may also be why I couldn't open a dispute on Paypal because eBay is in the process of reviewing the dispute. I will wait for a response from eBay and if it is not favorable then proceed to contact Paypal. Thank you for all your help.
Item Not As Described.
You can only have one case open at the same time so if you opened a case with eBay you need to wait until that is closed before being able to open a case in PP.
Even in Paypal - you should have 180 days to open the dispute, not sure what is going on, try calling Paypal

I get the above message when trying to open a dispute for this transaction.

Yes. I requested it by opening a dispute.
We have not been able to reach an agreement so I referred the matter to eBay.
The seller claims to not receive the package and also that he was not in "the office" over the long weekend even though that is irrelevant because it was delivered on Thursday 1st April before the long weekend.
I searched the address on google maps and the location is a residential house at the end of a cul-de-sac.
Regardless of the warranty, the box was damaged and not in the "brand new" description as listed on the eBay advertisement and this was the main basis for my request for a refund. The seller agreed to the return.
After registered post indicates the package has been delivered the seller claims he did not receive it. The only reason Auspost most likely left the package in a safe place is that it's a residential house in a quiet street at the end of a cul-de-sac. Yet the seller pretended to me as though he is working out of an office which is not true.

eBay provide a number of tools for buyers to get their money back for items that are not as described etc etc
But you have not mentioned following the correct procedure
You 'told' the seller you were returning the item
and you decided to request a refund
But how did you request it?
BUT did you do so by opening a dispute?
Or did you just send the seller an eBay message and ask they refund you?
Was the seller an authorised seller/ re-seller ?
If not, there is no warranty
Did the seller agree to the return?
Did they respond at all?
eBay do not read the forum, just other buyers and sellers like yourself
