Does the guarantee refund policy include used items listed as 'no refunds or returns'?

Re - The new money back guarantee policy as of Nov 1st - Can sellers still list used items as 'no refunds or returns' because the useless blurb on the site does not mention that? Plus does it apply to ALL sellers or just shop owners?
