I know you dont have to be a business to pay tax , thats what I am saying ,sure I might of called it a business, but if you earn money from buying goods then selling them ,call it what you like [its taxable income]

thats fine and correct  no tax payable until $18k ,but thats the total , but if you work and profits from selling go on top of your yearly pay then tax is payable on your total less the tax you have already paid from your job.

if your yearly pay from your work place is lets say $50k and you sold online  and made a profit of $5k   you are then taxed on $55k

Yes Hamsy what you say is correct according to my tax accountant.

If you are under $75K in total sales then you dont need to worry about GST at all. That's where we are.

 

Our accountatnt makes sure we remain under the income tax free thresholds (posted above) so we don't end up having to pay income tax either. So no worries there either.

 

But none of this takes away the requirement to declare ALL your income. There is a very fine line between hobby and a business venture. ATO would judge that based on your activities not you. And they will likely lean towards business venture. Therefore hobby is very difficult for you to prove to them. If it even smells like you are hoping to make profit then it would be judged a business activity, regardless of if/not you have an ABN.

 

If you are working a 9-5 job then every dollar from ZERO income in your selling activities will be added onto this and will be subject to tax.

 

If selling is your only income activity then as long as your taxable income remains under the thresholds (posted above) then you will have to pay ZERO income tax.

 

It's pretty easy for a smart tax accountant to legally keep you under the thresholds if you are already under the GST threshold. So IMHO you are better off to declare all your sales income and still pay ZERO tax than to hide it from them and be possibly caught out later on. If you don't declare it and they find out then they will likely impose penalties as well as ask for any back taxes due and you will then be on their radar for the future as well. You don't want that as they will never let go.

 

Our accountant told us its very unlikely they will come after us in any way (as in desktop audit) as we are only small fry and not subject to tax anyway. But the fact remains that they can still do it. And we are still legally obliged to declare all sales income.

 

So if ebay report you to the ATO for being over the $10K threshold then they will know about you. If they can't match this up with a tax return from you then you are likely to get a please explain letter, especially if you already have a 9-5 job on file as well. Our tax accountant advised us that it is always the wise approach to declare ALL income and then he will make sure (by legal means) that no tax is payable. That's why we pay him. Then everything is open and above board and you give them no reason to be on your case.

 

So I would urge anyone who sells on here to speak to a good tax accountant about all this, especially if you have received one of these emails recently and have not declared any sales income to the ATO. I don't want to hear about any of my selling colleagues getting into hot water with the ATO.

I think sellers get confused with gst against income tax. 2 different things , so forget about gst  its not what this is about.

once you have brought and sold something in a shop or online anywere ebay ,website,market.anywere.its taxable income ,your profit only. even if its $1, now at the moment anysales you do over $10k a year ,by law gets sent to the ato,unless you are selling only your own seconhand goods,must be entered in your taxable income , if you sell under $10k a year you still have to declare it by law ,but the ato do not have your info , but at anytime they can ask ebay or whoever i want details for bla bla Id. 

no diference if you are a pensioner or on benefits where you can earn so much before your payment are affected , selling is income ,unless its your own private goods.

Should have been the other way around, years ago $10K n now should be $40K.

 

Typical public servants thinking that peeps r getting massive profits from ebay.

The ATO are lowering the threshold to catch people that have more than one income but don't declare all of it.. a person may work in a salary job( e.g $40 000 a year) and sell part time on eBay. If they earn $10 000+ on eBay and don't declare it, they would owe tax.

 

Same for people in receipt of Centrelink benefits - checking if they are declaring all other income.

 

A person with only one source of income can earn up to $18 200 tax free.

7. Previous programs

 

The ATOโ€™s data matching program has been on-going since the 2007-08 financial year.

 

As indicated above, we have high confidence in our identity matching processes as we are matching on a number of identifiers.

The data is combined with other ATO data and used in various analytical models to identify appropriate cases for administrative action.

 

These programs have resulted in improved compliance and raised tax revenue. Over 6,000 individuals and businesses have been contacted in prior programs resulting in total tax and penalties of almost $4 million raised.

 

The on-going collection of online selling data enables the ATO to review and educate online sellers who are transitioning from hobby status to potentially being โ€˜in-businessโ€™. The ATO has published a โ€˜Hobby vs Businessโ€™ factsheet on ato.gov.au. This factsheet will help online sellers to determine if they are undertaking a business or a hobby and explains the registration requirements for those transitioning to business.
