Ebay you need to reinstate the negative feedback option for non paying buyers.  I have had numerous items bid on and not paid for because buyers know they can get away with this as their is no repercussion that affects their feedback score.  In fact several members had positive feedback but negative comments associated.

And although ebay may offer a credit for unpaid items, it cannot refund the time lost/wasted on these buyers.  Often a second chance offer is not accepted because the second chance buyer has purchased elsewhere in the time it has taken to try and get payment from the originaly buyer.

This is the question that I asked which elicited the response of "absolutely" from CQ

 

In this instance at least, he was not referring to "change of mind", but rather, "not as described"

can anybody point me to the policy that states if it is local pick up and you do not like the look of the item you can just

 

walk away and not honour the contract you committed to????

 

If a customer returns an item because another entity has decided they can

 

....how does that negate my legal right to remedy????

 

The fact that an item is bought on ebay from a distance does not allow the buyer to breach the contract.

 

The onus is on the buyer to make sure that the item is described correctly before they bid. If that is unpracticable then that gives them no lien to break the contract

If someone is a habitual non payer then they should not be allowed to buy on eBay period!

An example is with one i just closed myself on a non payer. I checked his feedback and saw about 30 feedbacks which all said the same story. "Seller does not pay and does not respond to messages. BEWARE". These are all within the last few months.

I dont think being able to give a negative as a seller would make a scrap of difference, but i think ebay should be tougher on those who dont pay and get rid of them all together



How do you know that all 30 did not complete the NPB process then ebay issued strikes but then overturned the lot?

BIDDER on the buyers feedback.....would we both then know how many of those '30 sellers" actually issued strikes....

 

and what about the sellers that did not know that the NPB policy even existed????

 

Do you think??? possibly... just possibly they may see  $$$$$$$$$$ NON PAYING BIDDER instead of "Seller does not

If your assumption was correct (and I do not think it is) that all 30 did not complete the NPB process ie (not even two of

 

them)...do you not think that curiosity would get the better of those numpty neg/pos leaving sellers so that they

 

discovered the NPB process and participated???

 

On top of that if you really believe that only 1 out of 30 sellers use the NPB system...then how could you have any faith

 

that the block system will work given that only 1 out of 30 participate???

IMO ebay board furphey

 

change the completed listing search parameters to items nearest first to see how many cars get sold mnay times over.

So when you end up in the small claims court I think you will find regardless of ebay's not as described policy or any other

 

ebay paypal or pretend policy if you commit to buy an item remotely via contract and that contract states that the item is

 

sold with all faults ie as is ................ and you forgo the chance of inspection or having your agent inspect that item for you

 

then the court will find you are obliged to honour the contract regardless of the condition of the item.

 

Caveat Emptor.

 

If the item is new and not fit for it's purpose then a buyer may have legal redress through consumer law even though the item was not inspected.

 

If it's secondhand...then you are stuffed

If a listing says - (for example)

 

No rust and it has rust, or

 

In roadworthy condition, and the tyres are bald or

 

It's a 1990 model when its plates say it is 1989 or

 

etc

 

then the item is not as described or not fit for purpose.

 

It's not policy, it is law

It does not matter what the listing says.

 

It does matter that you (or your agent) inspect the vehicle,item, whatever BEFORE YOU COMMIT TO PURCHASE and are

 

happy that the item matches the decsription.

 

That you waive inspection and bid on the faith or words written and pictures on a computer image does not allow you to

 

breach the contract.

 

ie the buyer has the chance to substantiate the sellers description prior to committing to the purchase but not post sale pre

 

payment...... regardless of cost to the buyer nor distance

ie. Crikey it is the buyers responsibility that they check the vehicle pre committment for rust even if the description states no

 

rust.

 

It is the buyer resoponsibility to check that the date of manufacture is as stated on the description pre commitment.

 

It is the buyers responsibilty to check that the seller is the registered owner......there is a case in point on the motors thread

Whose responsibilty was it to check that the seller was the registered owner on the link below ?

 

Who was then burdened and required to return the stolen vehicle?

 

Why?

 

Was the vehicle "as described"?

 

 Could the "buyer" get remedy in court because the vehicle was not as described?
