What do I do when a buyer purchases my item that is pick up only, who emails to say they will organise a courier and then opens a dispute because they have ben too busy to do this? What are my rights in this situation? I have emailed again with dates and times I am home and heard nothing again. I will not be refunding as this item has been relisted due to another buyer winning the item then arguing about it being pickup when it states quite clearly that it is PU only.

You must be listing on another id or its been more than 15 days as nothing showing.
You have the right to refund the payment & request Mutual Cancellation.You realy should have phoned them after refunding their Paypal payment to make them aware there is no buyer or seller protection using Paypal on pickup items.You could also have refunded & sent another invoice that included a postage price through pack n send which probably would have been very expensive.
Re the 1st buyer who presumably didn't pay,you have the right to open a non payer dispute,wait 4 days,close & ebay will issue them with a strike.

Simply ring Paypal, ask to speak to a supervisor, tell then โTHIS WAS A PICK-UP ITEMโ and that it has been and remains available for pick-up by the buyer or the authorised agent. Therefore the item is excluded from buyer protection.
Then if they refund the buyer, lodge a dispute with the Financial Ombudsman Service

foxette-in-sox yes the item is over 15 days old. Buyer bid,won and paid and then contacted me to see if it was ok for a courier to pick up. On the listing (and I have cut and pasted from my listing) was
Item is for local pick up only from Altona North Vic 3025
I WILL NOT POST/COURIER THIS ITEM
despite this, I agreed to courier and have contacted a number of times to arrange pick up for the courier. I don't see why I should phone and refund. I have been stuffed around twice with this item that has a clear pick up only. Thank you for your response, I appreciate you taking the time to help.

sorry, forgot to say it wasn't done through paypal, it was deposited into our bank account and done before the buyer contacted me to say "sorry, I'm interstate but can you arrange a courier as I really want the item".
I have emailed ebay customer support and asked them to cancel the item not recieved claim as the item was pick up only and I have bent over backwards to assist the buyer in having the item collected by a courier.

I would only have agreed to a courier if I was arranging it and the cost, which I would establish, was added to the invoice.
Bit confused, are you arranging the courier or is the buyer?
Has the buyer paid in full including the cost of delivery?

Gekajo3,you probably don't want to hear this but what Alana has written is technically correct.
If your buyer were to come to these boards & state what they've done & your refusal to refund,they'd be told to report you to Online Fraud.
I can sense your frustration BUT morally & legally,you really should just refund their money & ask for Mutual cancellation as obviously the item isn't going anywhere irrespective of the reason.
JMO but I would pick up the phone & ring them.
