Buyer returns item after 4 months and Paypal gives refund.

After 10 years on EBay and over 10000 sales and many millions of dollars in sales I knew it was too good to be true. We had our first PayPal refund for goods returned and surprise surprise the item is totally unsaleable. It has either been used not for the purpose it was intended (passenger car or truck) or it’s been immersed in salt water and used in a marine environment. The item an alternator and bracket both carry the tell-tale effects of salt water and even after we replaced the initial claim of a faulty item (alternator) we then had the buyer contact us saying that it too was faulty. We sell over 3000 of these a year (imported from the USA - not a Chinese knockoff) and in the past 13 years have had only one other claim for a faulty unit. We supplied photos of the returned item along with photos of the new item but because there is no scenario into which it fits PayPal have claimed the money, paid the buyer and for all intents and purposes the matter is closed. I for one do not believe that this is a isolated case, but one where the buyer has used and abused the item and because it has been returned PayPal have resolved the claim in the buyers favour. I should not be surprised by the action after 38 years in business and seeing a watering down of seller’s rights over this time.

Thanks to all who have sent replies all were great, there is a huge pool of knowledge out there. As for keeping a bit back from each sale the paperwork would kill us its bad enough sending BAS statements in every month of course a small amount is factored into the cost of the item the same way that currency fluctuations are. I vented my spleen over a $400.00 item which was on special for $234.50. Being ripped off by the buyer and PayPal certainly will not make or break us in the overall balance sheet. But the lack of integrity and knowledge that PayPal (perhaps we are naive) have in certain areas is alarming. Without even considering the photos or the condition of the item they presumed that this was how the item was supplied and therefore it was returned in that same condition. Now they require if we were to appeal the appeal already made then we have to either make a Police report (about what) or Complete the supplied affidavit and have it notarized. You must fax or upload the police/incident report or affidavit to PayPal within 10 calendar days someplace in the USA. By the time that you do all that the time to the company far outweighs any cost benefit that you maybe reimbursed for. The procedure works on the basis because the items are relatively small in monetary value you will just go away. I have included a couple of photos so you can spot the difference between new and what was returned.

Did you even bother reading my post #9 above? I've given you all the information you need to have the best possible chance of getting Paypal to reverse their decision and refund your money, but if it's too time-consuming or you simply couldn't be bothered, then several hundred dollars obviously means far more to me than it does to you.

Affidavit means Statutory Declaration.

Basically just make a statement about the sequence of events

and have your signature witnessed by a JP.

Photograph it and upload it as a jpeg file.

If PayPal won't play ball then use the ombusman link provided by cq_tech.

Don't let the buyer get away with it.

im now going thru the same process buyer buys item 11 weeks ago

now says item not as described

its a $100 item

if the item was not as described why the hell does buyer wait 11 weeks to lodge a complaint

and now want a refund

ive told buyer to send the item back to me for full refund

but after 11 weeks gawd knows what i will get back  

same here over 7000 possitives and buyer gives me my first negative

and calls me decietfull

sorry but any seller that has over 7000 possitives 100% rating
