Buyers wants a refund, I have a no return policy. Item is a used phone with damaged screen.
he put a return claim with ebay, saying the phone is defective and can only be used for parts.
Ebay sided with the buyer of course.
I have received the phone with a dead battery, i sent it out full charge.
I can see he has used the phone for quite some time as the call log is still on there.
Ebay are now trying to charge me $$$ for the listing but also want me to refund the money.
Am i obligated to do so? i feel the buyer just changed his mind, i dont think this is fair.

Good luck with that. But you will still have to refund this customer regardless of your no refunds policy, unless you can satisfy eBay and Paypal that the item was as described, which seems unlikely. If you don't, eBay will simply refund the customer from your Paypal account and give you a defect (which you will probably get anyway).
On the off-chance that you have a similar experience with the next sale, do us all a favour and don't bother coming here for advice. You don't listen to it when offered, and have done nothing but insult and offend the posters who tried to help you right from the start. Some of the most respected forum regulars, I might add. As for saarzi's English, as an academic I can tell you it is far superior to your own.

Penny, he's already got a defect, from the negative feedback the buyer gave him. When eBay closes the case in the buyers favour (which they will because we know they always do), he will then have a closed without resolution defect too.

You came here looking for advice, experienced members gave you advice, then when you didn't like what you heard, you start insulting people. Not a very noble thing to do now, is it? As for me (and others) replying, this is a public forum and if we wish to post replies, we will. It's not up to you to decided who can and can't respond on a thread.
All the sellers here are just so grateful you did post your message! You have no idea just how grateful we are!

You may as well bang your head against a brick wall as try to make a valid point with the OP. Their penchant for getting it wrong is spectacular. I mentioned perhaps sell it as for spares or repair and the OP responds they will list it in parts! Where is there any connection between the two?
They have COD as a payment method, do they really mean they will deliver it to anywhere in Australia and get paid for the item and delivery when it arrives with the buyer?
Last and by no means least they quote for a pre paid satchel. It is against Aus Post policy to put anything on the dangerous goods list in a prepaid satchel, that includes mobile phones which have to be sent regular parcel with a road only sticker on them.

They can sell as-is for parts, or in parts, I guess. Whatever covers them against another return.
