I posted a parcel to Canada, using Australia Post registered air mail, with signature required on delivery but without online tracking. The buyer opened a case saying that he did not receive the parcel. I requested Australia Post to investigate this parcel immediately. While Australia Post is still investigating, I received a message from ebay saying that they will contact me if they have any questions.
A few days ago, I checked my paypal account and suddenly found that the money was already refunded. Ebay made final decision without asking any questions, even without informing me the results.
I have all the evidence to prove that the parcel is posted. If ebay make a phone call to Australia Post, they can learn about the status of the parcel. How can ebay issue full refund without looking at the basic facts???
Douring the entire process. there is no option to upload/send any documents to ebay, so I sent them to the buyer in ebay system.
Ebay said that it is final decision.
Where is seller protection???
How can I resovle this problem with some justice? Can I bring it to ACCC or a small court?
I have long known that buyer and seller are not equal on ebay, but I have never realized that sellers can be ripped off like this....
It is a robbery, I would like to say.

If AUPOST find the parcel is lost, which has never happened, they will compensate the loss
If AUPOST find the parcel is delivered and provide the buyer's signature, I will get nothing
ebay made final decision before AUPOST completes their investigation. ebay's final decision does not have any support and it is purely based on the buyer's claim which is not verified.

Here you go. Took all of 10 seconds to find -
http://pages.ebay.com.au/help/sell/questions/sell_international_requirements.html
When you trade internationally, you need to verify that you're following all laws in other countries, which can differ from laws in your own country.
When selling internationally – for example, either by listing on a site other than your site of registration or by selecting an international postage option – your item may be sold to a buyer on another eBay site and/or in another country.
Before permitting you to sell internationally, we may ask you to sign an International Selling Agreement acknowledging that items sold to buyers on other eBay sites will be subject to the policies of those sites, including their buyer protection policies.

I No longer send things overseas without tracking i also put $5 for postage and handling as ebay slugs you on international postage as well, they should have an option where is chagre 10% for handling fees, but there is only a dollar amount, so go figure !

It is more exciting now. After ebay fully refunded the buyer $41.6 one month ago, today ebay sent me another invoice to charge me another $41.6 for the same case, which will be charged on my paypal automatically. How ridiculous is that?! Can things be worse? I have all the postage evidence and am stil waiting for AUPOST to investigate the parcel, and has been charged twice by ebay without any legal reason.

Doubtful. eBay, whilst they have many faults, don't charge twice for the same transaction. Even if they did, it would be their commission, not the full amount of the transaction.
Try leaving the hyperbole out.

Ebay did it and it is true.

Then take legal action. Simple

I have sent a message to ebay to cancel this invoice.
If ebay insists that, after refunding the buyer's full payment of $41.6, I must pay $41.6 to ebay as well , which is nothing but an open robbery, I will definitely charge ebay to a court and all the fees involed will become ebay's responsibility to pay.

Did ebay refund the buyer from your funds or theirs?
If they used their funds they do expect you to repay them.
Good luck with any court case you may implement.
