Can you list an item like a tv, cd, radio etc etc and say you might get this brand or this brand or this brand but not actually state what you will get. Just that it will be one of those brands? I thought it was against Ebay policy.

Don't know about the legailities of doing it but I'd have to say that you would be setting yourself up for INAD claims left right and centre.

IND case,buyer gets a refund and probably gets to keep the item with a bit of luck.

I do not do that. I only list the exact item but I notice many do what I was asking and I thought it as illegal on here yet Ebay seems to allow it. The sellers doing it dont receive negatives for it at all which is weird so I thought you must be able to do it.

If it doesn't get reported to ebay then just like fake items will keep on selling and ebays economy$$$$ will be rolling in
