It's not an unpaid case it's a cancel transaction case which the buyer has 7 days to respond and if they don't then I can close the case,but obviously I can't do it.

When I opened the case it said that after 7 days if no response from the buyer you may then come back and close the case,have ebay changed it to 8 days now?

In future, if a buyer doesn't pay, open an unpaid case. That way if they don't pay they get a strike. Offering a cancellation lets them off scott free.
Yes, it's 7 days for a cancellation. When you said the buyer hadn't paid, I automatically assumed you'd opened an unpaid case.
What reason did you give for the cancellation? Some of the options trigger defects, which is another reason you should be careful about offering them.

It's always been technically 8 days, as far as I know. It's a little confusing when you look up the info - before I had a buyer that never responded to a cancellation request, I was under the impression that I could close the case on the 7th day, but in practice, the buyer has 7 full days to respond, and the seller can take action after that, which means on the 8th day - it's to the hour, though, i.e. 7 x 24 hours, so if open in the morning on a Monday, you should be able to close the following Monday afternoon.
You can tell if you're able to take action on a case by the status, which changes from "awaiting buyer's response" or similar, to something like "you can close this case now" or "take action / receive fee credit".

A lot has changed recently, but in the past a Mutual Cancellation case closed automatically in the favour of the member who opened the cancellation if there was no response from the other party.

You can close the case after 7 days not 8 days,and if your not able to do that then ebay is giving the buyer extra time in my opinion to respond thus then not having too return FVFs,keeping their fingers xd the buyer responds,to me this is double standards and very unfair to the seller as the seller can not move on or relist the item as the buyer is obviously stalling because after 7 days and no response either way agree or not agree is ridiculous.

unless you want to cancel because you have made an error or it is a regular customer you trust why on earth would you offer a mutual cancellation and not open an unpaid item dispute? You can still close after 8 days and the buyer cannot leave you feedback nor can they trash your DSRs. They also get an unpaid item strike which, if you have your settings at the most secure level, means they will be blocked from bidding if they have done it more than once.
It is doing all sellers a disservice not to issue strikes when they are called for.
