HELP!Sold item for first time. Buyer has item and still hasn't paid for it.

So here's my story, I was going to upgrade my phone so I figured I would sell my old phone on eBay. I posted it on here, it was an iPhone 4 32gb factory unlocked for $330. When I checked the next day how it was going someone already bought it. I then received an email from eBay saying it sold and that I would receive my funds the sooner I sent it out. I was confused by this and did research about it and found out that first time sellers have their funds on hold until the buyer gets the item (I read this all from eBay). So I sent it out on a Saturday and he received the package on Monday, which he signed for. I then waited a couple days for my funds and a response from the buyer asking him how he liked it. A couple days went by and no money and no response, so I called eBay and they directed me to PayPal. When I talked to them they told me that I was not going to receive any funds because the buyer never even paid. I contacted eBay and they gave did not help very much, they just told me that I should try contacting law enforcement and the buyer. I tried both, buyer won't respond to anything, and the law enforcement isn't helping at all either. I don't know what to do anymore and don't want to sue anyone but I really needed that money. PLEASE someone tell me what I should do! The buyers username is jrrezvi73

HELP!Sold item for first time. Buyer has item and still hasn't paid for it.

I really feel for this OP.

Almost all of us made a mistake when we first began, but usually it isn't such an expensive one. It's a shame.

It may seem "obvious" to only post once payment is received, but it's a simple mistake many have probably done.

Sorry OP ๐Ÿ˜ž

I believe ebay should make everyone read about how to buy and sell including the policies before they can become a member. That would help to to prevent mistakes like this occuring.

How could they enforce it though?

How many people read TOS before installing a program? I never do. I just click "agree". That'd happen here too.

Ebay just do things the way they want to I think so I don't want to suggest it to them. No it isn't enforcable.

Do not be sorry. In the US ebay does hold new sellers funds. The Op may have been scammed alternatively they may not have followed the procedure below or mi8sunderstood ebays command "

As part of the payment process for new eBay sellers, PayPal may hold your PayPal payments from buyers for up to 21 days.

To help get your money faster, please ship the item quickly and provide tracking information or delivery confirmation.

eBay and PayPal define new seller accounts as one with less than 90 days since the first successful sale of an item.

This is an important security process for eBay.

It helps keep our site a safe place for buyers and a thriving marketplace for sellers. We appreciate your understanding.

Learn more about this process in the FAQs below. Or, read the full details of the PayPal holds policy for new eBay sellers.

FAQs

What is a hold?
A hold is an amount of money that belongs to you, but is temporarily set aside by PayPal.

When you get paid by a buyer, the money is credited to your PayPal account but not all of it will be immediately available.

Part of the payment will show as pending in your PayPal account. This means you won't be able to spend or transfer the money while the hold is in place.

How long is the hold?
Usually up to 21 days, but you may be able to access your money sooner if item delivery is confirmed or if you receive a positive Feedback from the buyer. As long as there is no buyer dispute, claim, chargeback, or other negative action on your account, the hold will be released after 21 days.

To learn how to ensure a smooth, successful selling experience, see our selling tips and selling practices policy page. See also When will I stop getting my payments held?

Is there anything I can do to get my money faster?
Yes! Your money may be released if:

  • 24 hours after the buyer leaves positive Feedback or;

  • 3 days after PayPal confirms that the item was delivered

Belinda, if the OP takes your advice he/she will most likely end up sued for slander or charged with stalking.  The above post by viewmont has explained what is most likely happening.

I wonder if the seller & buyer live in the same city? If so, such misunderstandings are often far more easily remedied on a face-to-face basis, IYKWIM.
