I have bought an item and am now unable to take possession. Can i resell it before possessing?

so i bought an item for 250 dollars and now cannot pick it up - can i relist, even though it is still at original sellers house, and sell it to someone who can pick it up?

i won't mind selling it for not very much but the time factor is crucial as they say they will only hold it until next sunday...

Not sure how the seller would go in that situation legally bsal - putting the buyers goods on a public footpath................hmmm....

 

The OP's in a bad situation here due to the circumstances where they live, hopefully they can sort something out before the weekend.

Thats the point Padi, the goods are no longer the former owners. The seller has given the OP a timeframe to remove the goods from their storage/premises. Once timeframe is up then its on the footpath for the OP to come pick up at their leisure.

In your Post #6 you said the seller was under the impression that the item was not worth as much since it was dismantled, so they may only be willing to give you a partial refund on it.

You can sell it as it is yours legally.  You have purchased and paid for the goods.

 

If you ran a short timeframe listing eg. 2 days, with clear deadline for pickup.  If it did sell, you could potentially organise to meet a new buyer in the vicinity of (but not on) the sellers premises to pass it on to them after you have moved it off the original sellers premises.

 

Only just a thought off top of my head . ... but loaded with potential issues, but maybe worth thinking through and attempting to negotiate with the seller. 

 

However, I reckon a Plan B is required, as goods may not sell, if it does, the buyer may not turn up to pick goods up at nominated time, do you have your own photos or need to seek permission seller to use theirs etc etc

Wasn't there something mentioned on another post some time ago concerning the obligations of a seller if the item was not picked up at a certain time ? I recall that he charged a storage fee or some such thing...What are the legalities of someone ditching the paid for goods onto the footpath ? Anyone remember this..?
