If you opened a cancellation and there is no response from the buyer, you should be able to close it after 7 days.

You need to lodge an unpaid item dispute through eBay Resolution Centre. The buyer has four days from that date of lodgement to pay. If this does not happen you can then close this dispute and ONLY then can you relist your item. So it you had already lodged the dispute you would have your Final Value Fees back and you would have been free to relist AND that NON payer buyer would have a strike.
Make sure you set up your Seller Preferences to exclude any buyers from buying from you who have a non paying strike against their ID. This is sellers' insurance that they will not be pestered/inconvenienced by these buyers who have little regard for the inconvenience they cause by not paying. Hope that helps

Thank you for that information. unfortunately I wrongly sent a cancell the order request and now I am waiting for Ebay to get a reply from the buyer as to whether they received a refund from me. What a joke, they dont answer their mobile or any emails. So 11 days after she won the item I am still in limbo. Ebay blocks me when I try to open an unpaid item dispute they say I already have a dispute in progress. I have sent emails to ebay explaining this and asked them to call me. No joy there! I notice that the fees for this item are still in my March invoice.
