PAYPAL DISPUTE - URGENT HELP PLEASE

I sold a doll to a buyer in Italy - REGISTERED POST 24 JANUARY 2014. The buyer lodged an ITEM NOT RECEIVED against me.

The buyer refused to pay $30 (customs fee?) so Milan P O will not deliver it.

PAYPAL HAS RULED IN HER FAVOUR BECAUSE THERE IS NO TRACKING NUMBER.

AUSTRALIA POST HAVE INVESTIGATED THIS FOR ME AND SAID THAT THE PARCEL ARRIVED IN MILAN 1ST FEBRUARY.

I HAVE SENT PAYPAL ALL THE INFO EG. REGISTERED DOC AND EXPLAINED MY CIRCUMSTANCES.

DOES ANYONE THINK THIS IS FAIR THAT THIS EBAYER IS ALLOWED TO BREAK THE CONTRACT??? I AM SO VERY UPSET.

But Dave if it was sent with a required signature on delivery then even in Australia they would rule you must have that signature or it would be a INR and nothing the seller could do as that was the way the postage had been paid for. The seller may argue your point about Proof Of Postage but the buyer could also argue that they paid for a Proof of Delivery by having to sign on delivery.

 

Still this doesnt help the OP. As people have said it may be that the site they bought off required Proof of Delivery and personnally I think ebay should also make that rule here in Australia. Think of how many INR claims that would stop.

Bsal, you do not need signature on delivery to win a PayPal dispute (seller). You saying that if a buyer refuses delivery (no signature obviously) that the buyer would win the case? All you need is proof of lodgement just as Dave mentioned.

We get into a grey area here. Now it gets down to a he said she said thing unless AP get something from the buyer saying they have refused delivery. Its still buyers word against AP unless a signature is produced.

bsal.... the GST equivalent in Italy is probably 27% (it is in many EU countries for imports from non-EU countries), and the parcel was declared at $100.... so with the customs handling fee that'd be right for most EU countries.

 

they dont have a $1,000 GST free threshold like we do in Australia. !!!

Nothing grey about it at all in Australia, which is a scenario you brought up.

 

And the Milan PO has said the buyer refused delivery, so not too much he said, she said there. An impartial third party I consider.

 

Please try to ascertain some facts.

Although the site does not work for all countries delivery pPostal service

 

......try tracking your AP registered post number on this site.

 

I have found the best way to use this site is to manually select the destination country but let the program autoselect the carrier. (rather than selecting AP as the carrier the program selected JP)

 

If it shows tracking to the Italian Post office then you can prove that the item is awaiting collection by the recipient and gives you another layer of evidenece that is available online.

If you click on the community spirit thread URL below and try tracking the International registered post number on the AP tracking site I quoted in my post you will get no results but then if you try it on the "track it online" site you can see the resultant tracking has been gleaned from the destination countries site.

 

As an aside for some countries you can even track the customs declaration number ie CN ********* from the little green and white customs forms that need to be filled in and attached to items under $500 in value.

 

(You need to manually record that number as you do not get a copy of the CN customs form as you do with the

 

registered post forms and in this particular case the Int. reg post form is also the custom declaration)

You won't get AP giving you this info becasue it only highlights their service is ofeten trackable although they do not offer it on their tracking site
