I sold an item and sent with fully insurance,the item is damaged during the postage, the buyer put in a dispute thru Paypal instead of going to post office and put a claim in and now over a mont of dispute Paypal ask me to refund. I am losing out on insurance that i paid for and now I have to refund the money to the buyer?? where is the protection for the seller? when the item is sent the buyer has the same responsible as the seller, put in a claim form to the postage company so both seller and buyer will get thier money back.Thanks

Contact Paypal by phone and explain that the item you received back from the buyer is not the one you sold them, and ask them how they would like you to proceed now.



Also contact the buyer and advise them that you have received the wrong item back from them.

Paypal took $1000 out of my account, paid back to the buyer, it costed me $30 in postage + $79 for ebay fee and a microphone that not belong to me. is there any way can I get ebay fee back?

Phone Paypal. Tell them that the item the buyer returned is not what you sent them. Tell them if they dont refund your money you will take this to the Financial Services Ombudsman.

Is this buyer in Australia???


Do you have clear photos of the item under dispute???


Do you have the serial number of the item you sent the buyer???


 


If the answer to those questions is YES you shouldn't waste your time playing games with Ebay or Paypal because the Australian Federal Police Fraud Squad would love to talk to you about it all.


 


 


 


All you need do concerning Ebay and Paypal is to notify them that the buyer has returned a totally different item to the one youi sent them, and you have the photos to prove it, and can provide the serial number etc. and tell them that if they do not immediatelt correct THEIR ERROR you will be handing the matter over to the Federal Fraud Squad immediately.


 


Thieft is thief, and going by what you are saying here there's no disputing the fact.


 


The police will only be interested in getting a conviction against the buyer for the thief, but once they have achieved that you are entitled to claim criminal compensation for your loss, plus costs etc.


 


Go for it and don't back down no matter what anyone else tells you.


 


If the buyer is OS you are pretty well screwed.

Yes, photo of original and the one received


Yes, series # of original but no series # on the received one.


I did offer to either get a new board fitted or I can get one from Brisbane sound if they still have one and I am  still waiting for a reply.


Paypal just sent me a email asking how is different from the one I sent?

You have all you need to help the police sort things out for you, so get in contact with them immediately and just tell Paypal that you've done it because the police may well want to talk to them too.


 


The serial number alone on the original item you sent to the buyer is enough to gain a conviction against them, but the more details you can provide the federal police with the easier it will be for them to do their job.


 


Just don't tell the buyer you have all that sort of info or they could try move in on in a hurry.

Should paypal have refunded already without notice/confirmation from seller that the returned item had been received? I read OP as only just receiving the item on Friday. Surely, the correct procedure would be for the seller to confirm receipt of item with PP, then PP would take relevant steps if necessary?? Otherwise, as soon as a buyer posted back, PP refunds would be shooting out all over the place, (and items that go missing, what then?) this definitely does not sound right to me. The suggestion to go to police is a good one, but I would be fighting the payal decision first up, trying to get the funds frozen in buyers account until it is sorted.

Sometimes both Paypal and Ebay tend to think they are laws unto themselves and need to be put back in their boxes, and the only way to do that is by ensuring they follow the laws of the land.


 


The longer you put that off, the less chance you have of winning your case in the courts.


 


By involving the police in this sort of case you will incur no cost factors because it's a crimminal matter, not civil.


 


By getting the police involved immediately you're sending a clear signal to Ebay and Paypal that you won't be stuffed about by them, but if you don't tell them what you're doing as you're doing it they can't act accordingly.


 


The funds concerned SHOULD be frozen immediately until the dispute has been sorted out fully, but if you don't get the police involved in such a large sum transaction Paypal will go their own way as though they are God.


 


Neither Paypal or Ebay are the slightest bit interested in you as a person, or customer, they are only interested in making money for themselves and hope the problems will just go away.


Their continual statements of looking out for the rights of all concerned are total BS.

Hi All,


I have received 3 email from Paypal since I confirmed the item is received,


first email, " delivery of the item has been confirmed and a refund will be issued from your account"


second email, " the cased is closed and refunded to the buyer"


and an email received this morning "we are contacting you with an update on your case and a request for some additional information"


 


this is the first time PP contact me to give them additional information.


Why do they need information now when they already make their decision to refund the money to the buyer?


I am thinking of closing my PP account as i am paying the fee but get nothing out of them.

CALL PP, emailing is a waste of time, all you will get are automatic responce.  If you call them you will get human being.  It is free to call.
