I bet they dont hold the big boys paypal money, like Masters, Jb-hi fi etc.

Why would they?. They are registered businesses in Australia, not likely to be scammers and do a moonlight flit with buyers money, like a small non business seller could.

Jurisdiction

The Tribunal does not have a general power to review decisions made under Commonwealth or Norfolk Island legislation. The Tribunal can only review a decision if an Act, regulation or other legislative instrument states that the decision is subject to review by the Tribunal.

The Tribunal has jurisdiction to review decisions made under more than 400 Commonwealth Acts and legislative instruments. The largest part of the Tribunal's workload arises from applications about decisions in the areas of family assistance and social security, taxation, veterans' affairs and workers' compensation. The Tribunal also reviews decisions in areas such as bankruptcy, child support, citizenship and immigration, civil aviation, corporations and financial services regulation, customs, freedom of information, industry assistance, mutual recognition of occupations, passports and security assessments by the Australian Security Intelligence Organisation (ASIO). Since 1 July 2013, the Tribunal's jurisdiction includes the review of decisions made under the National Disability Insurance Scheme.

In relation to Norfolk Island, the Tribunal has jurisdiction to review decisions made under 39 enactments. The decisions subject to review are specified in the Administrative Appeals Tribunal Regulations and include decisions about customs, planning and social services.

Was the NSW Triibunal NCAT used to be fair trading but the TRIBUNAL none ythe less not the administrative appeals tribunal.http://www.ncat.nsw.gov.au/ And they certainly do have jurisdiction.

Why ?

Because if someone does put in a claim, it would cost them heaps to defend it, let alone the time to get all the information together.
Cheaper just to release the funds.

Big companies do not like to risk losing in Court.I have sued Ebay and Paypal.

The first time Ebay suspended me and my wife.My wife was suspended purely because she had same address.Took them to the Tribunal in NSW.They settled out of court for $1200.00 and reinstatement. When Paypal underwent the USA class action and it was extended to Australia roughly 10 years ago I joined because they took 69 cents from my account and closed my account. There was 3 ways to go.Short form long form and common law.I went common law and claimed $250,000.00.I was awarded full amount but it PRORATA paid so I received $4300.00.

What paypal is doing is unlawful in a civil sense.

The TORTS they are committing is breach of contract detinue and conversion.

If they have your money simply ring and threaten a civil suit through your state tribunal or that you will go to the  Financial Ombudsman.

The Tribunal has jurisdiction in every state.

DETINUE The wrongful taking of property.CONVERSION Converting that property to your own use.

The terms and conditions do not allow them to take money and hold it when there is no cause.

Taking the money is detinue.Using it to get even just interest is conversion.

FILE the case if they will not release or ring Ombudsman.

You WILL WIN.Damages in Australia for detinue and conversion are AT LARGE meaning if they take $100 you can get any amount the judge or tribunal member can be convinced to give.Big companies NEARLY always settle out of coutrt because they do not want the risk of losing.

You do not have a clue what you are talking about. They are holding the money based on nothing. They are taking money from people with 100% ratings who are selling small priced items  every now and then.We are talking $25 a week in sales and they are still putting them on hold.

It has nothing to do with "scammers".As usual you speak without knowing.
