Hi - following on from my previous post - does anyone know what the statute timeframe is for Victoria in regard to abandoned goods? When can I resell the items or give them away after purchaser has paid for but not collected them?
Even Ebay have not responded to my question yesterday about what to do in this situation.
Where's the Ebay legal team when you need them?
Anyone?

You received payment on 28 November? 12 days ago? Way too early to think of disposing of the item.
Why don't you ring the buyer and finalise pickup details over the phone?
What was the value? There's info on the Consumer Affairs website for low value items.

If you've had problems with the buyer and do not want to call them why not just post the item and get it out of the way.

Hi - note the item was sold on 19 Nov and paid for 8 days later. Because of such slow payment I offered at the time to cancel the transaction because I hate the hassle of it all but the purchaser paid up. I have offered to send another invoice for postage via paypal and the purchaser keeps saying he wants to collect the items. So I've covered all my bases.
The purchaser was so slow to pay and I'm not refunding after I have offered to cancel the transaction in the first instance and I'm not paying for his postage either - I'm too annoyed to do any favours for him!
And thank you - I'll check out consumer affairs. The item was around $20 mark.

I can't help.
If a buyer doesn't pay within 8 days they get a NPB strike. End of.

But Dave they paid on the 8th day so the seller is stuck with this buyer.

Yes, I am stuck with the buyer and I did offer to cancel the transaction before he paid. I have also offered to post items if he paid for postage - he would not pay $6.95. I think that kind of says it all to me!! Just a difficult buyer and I'm stuck with him!

If it's only a small item stick it in a cupboard somewhere until he arranges to pick it up. If you really want to be rid of it (and the buyer) save yourself a lot of worry and time and just post the item.

yes just file it away and make no further contact with the buyer. If he contacts you, then arrange the local pickup. If after 60 days the buter has not picked up the item, then re-list it - the buyer is unable to leave you a neg after that period of time.

Thanks jmfgray - best advice yet!! I have given the buyer until 20 December and then I'm taking the item off my doorstep and will put it away in a cupboard for a few months. Really is just so unfair on sellers - what is the point of setting "terms" for payment and collection and having buyers do whatever they want anyway and there's nothing you can do about it! Anyway, problem solved (for now)! Thanks again!
